My car is getting fixed!!!! Wreck not my fault!!

The insurance investigator declared the wreck as the lady in the Jeep that pulled out in front of me's fault. I am getting the whole car repainted, everything thats broken will be replaced with brand new Nissan parts, anything wrong with the 5spd (gettin my transmission rebuilt for free from a friend), everything, is getting fixed at the insurance companies expense. Guys you dont understand how hyped I am right now!! This is great! I am going to try and get the car repainted with a color only on 1996 240sx's. It is a purple/blue, more of a purple most of the time. It is absolutely gorgeous. Well I just wanted to give everyone that cared the latest update w/ me and my car situation. Thanks for all the support through the whole situation too, it helped alot!

I've seen a 95' in that colour... sorry to burst your bubble... maybe I'm wrong... anyway, that's totally sweet! It's great that they realized she'd pulled out rather than the normal "you hit her from the rear!" thing! Have fun!

Thanks....and it really was only available on the '96's. You might have actually seen a '96 painted that color, with the slated grill, not the open grill that are associated w/ most '96's. Some '96's got the slated grill which the '95's had. You get all that? heh

Congratulations dude; I'm glad to see you're getting it fixed. Insurance companies are wising up the scams idiots are trying by pulling out in front of someone. I had one friend who had this junker pull in front of him and slam his brakes. This Mexican guy gets out holding his hand out saying, "Dinero! Dinero!" My buddy replied with, "No money. Insurance." The guy just got back in his car and drove off.

It's a 95' for sure, a friend of my brother's has it (just dropped in an SR too, woot!). Blue Emerald is listed as a colour for 95's on Edmunds, and the car looks purple 90% of the time.

His car is already Blue Emerald....that is greenish blue.

There is another purplish/gray color called Concord Gray which was also available in 95.

Ben is talking about Mediterranean Blue...a bluish purple (check my signature links) and was NOT available in 1995.

Ahh... right... I don't know the colours very well. I assume it is similar to the 95' colour? Cool. Sounds beautiful, good luck again 95silviase!

Some auto insurance companies have policies that state, if the car is over 5 years old, shops can not used new parts when doing insurance work. I would make sure that is not the case here.

Sorry to have to open your eyes to reality, but it's all the policy holders that bear the expense.

As long as the claim is legitimate and all repairs are for damages caused by the accident, I'm happy about your outcome. If not, then you are adding to the supposedly victimless crime of fraud. Not to single you out, but your post makes it sound like they are paying for something they shouldn't be...

What scam? I've never heard of that. And it would make no sense for someone to try and make a planned scam out of this type of loss. The more typical scam is the swoop and squat. A car gets in front of the victim and establish their position. Then another car cuts off the car that is in front of the victim causing this car to slam on it's brakes and causing the victim to rear end it. A rear end accident doesn't leave much room for a liability argument. Someone pulling out of a driveway leaves a lot of room and if the scammer were unfortunate enough that a witness was around, his own insurance would end up paying...

I have not seen anything like this, and would find it unlikely since used parts and even aftermarket parts are not always available. Most leave this open to interpretation. But I will say, I see nothing wrong with using used parts. After all, your damaged parts were used parts too...

As far as new parts, as I said before....its the policy holders that pay for the new parts. I for one don't mind seeing used parts go on my car if I can help to keep my premiums down.

Update: it is the other persons fault, but the insurance hasnt' declared it totaled or not yet. If they total it, I can probably get about 6700 for it, which means I would be able to buy it back for about 1600 bucks and fix it with the rest of the money. This way, I will be able to buy used parts from all of my NICO buds :)

If its *not* totalled, well, it will be a close call. I am emailing pics of the wreck (i took digital pics about 5 minutes after the wreck, with my car still on the road and everthing) to the insurnace people. The guy is going to look at it, determine a value, and see if its totaled. A good way for me to have it declared not totalled is send ALL my receipts (which I have them for everything I have done to the car) to the insurance to let them see what all is done to the car to raise the value. I may be able to get the value up enough to where it isnt' totalled, which means I get all brand new Nissan parts put on the car.

So there is the latest update.

How so? I've been adjusting auto claims in California for nearly 6 years and never heard of this. Our fraud investigation unit has no warnings out on this type of scam. And I'm not referring to after-the-fact scams, but rather planned or staged accidents. If people are doing it by pulling out in front of someone to try and pull off a scam, then they need to go back to fraud school. It would be pretty dumb to try to stage an accident that would likely end up being that person's fault, or even questionable.
