My car has the most problems ever...but not a single thing was fixed...lawsuit..

As you all my have read my long ago post, about my clutch and other problems, but non have been fixed...literrally...not one, when there is about 6

i have not yet gotten 1 problem fixed yet. Today i called nissan canada for the 6th time and bitched the hell out of them and told them this was there last chance, and i am suing them if i dont get a reasonable answer.

I will sue them for either a FULL refund, or a New altima Plus cash for wasting over 80hours of my time (went to dealership 11 times, spent over 80 hours without a vechicle when im a full time student and working)

After i told them what i was ganna do, they finally told me they will contact the head person who will give me a final solution for my vehicle.

What do you guys think if would happen if i actually take my case to court? What is the chances of me winning, and how long will it take it get this case over?

I had a buddy of mine get a vehicle bought back under lemon law. This is going to sound very naive but I don't know what Canada's lemon law is. In the U.S. you have to take the car back to the dealership a minimum of 3(?) times to give them ample oppurtunity to fix the problem. If they are unable to fix the problem then you can "sue." However you need to contact a good lemon law attorney and they handle all of the litigation procedures for you.

I would not bother "suing" them on your own. You will want to do some research on the lemon laws of your country and find out if they are working with in the law. If they are, there is nothing you can do about it. If they aren't then contacting a lawyer.

When my buddy had his truck bought back he got back every single dime he put into it. They didn't even take depreciation or mileage into consideration even though it was over a year old and had around 15,000 miles on it.

Lemon Laws are for AMERICANS! Maybe theres a LIME law for Canada? Id do some searching... Also, when things get in lawyers hands (who are paid by the hr ofcourse) things have a habit of slowing down and taking lots of time...

the stipulations for lemon laws here in the US are pretty difficult to reach as well... its not just bringing a car back 3 times for a problem.. it has to be a significant defect.. (i think the clutch qualifies tho)

I wasn't too sure what the law is as far as how many times the vehicle has to go back to the dealership. I just know that when my buddie's super-duty went back to the dealership for the third time on the flat-bed due to a blown head gasket they started the paperwork. But he had 15 receipts from previous "repairs/inspections" of similar problems. I know it wasn't easy for him.

yeah... a blown head gasket also qualifies...

For those who dont know the first thing about lemon laws... please dont think that because you brought your car to the dealership 10 times because of a seat rattle, that your getting a new ride..

lol of course.... im talking about bringing my car to the dealership, about 8 times for the clutch itself (along with other stuff too).

I dono about the lemon law in canada, trying to search it. Is it actually called "lemon law"? or is there anotehr term i could search?

i know finding a lawyer will cost me money (but im broke i believe i qualify for legal aid LOL), and time consuming, but if in the end i win, its worth it.

And right now im still waiting for nissan canada to call me back for there "solution" to my problem. I dont trust the dealerships, and i dont trust nissan. I want a new car or full refund, if not, they can wait for a lawyers letter

anymore suggestions to help me out here would be great. Thanks

i thought you could only qualify for legal aid in defense... IDK anything about canada.. yes its called the "lemon law" here in the states

Like LBC said, lemon laws are not for simple things like rattles. If you are having problems with your vehicle that prevent you from being able to drive it then you MIGHT qualify for a lemon law...but the lemon law process is a pain in the butt.

I don't know exactly what is going on with your clutch but in my opinion clutch related issues should be pretty easy to fix...

And for Kyle, my clutch isnt "easy" to fix, not after taking to 2 dealerships, both said cant find the problem, but they tell there is definetly something wrong. But i have taken it to the dealership dozens of time, becasue my clutch fails and falls half way to the ground, and the pump action loses power hte more i drive (stronger when at cold start vs 30minutes of driving)

This type of clutch fails at random times, and has a very loud sqeek/clicking noise as i step thru. With a unsteady/unsafe clutch like this, it can cause accidents on the road (atleast its not the brakes). Chances of a clutch causing me a big accident isnt high, but there still lies a risk for me, which i believe nissan is reliable for if in that case i do get into an accident BECAUSE of this clutch.

Then the minor stuff is just the icing/side dishes compared to my clutch

I will be hearing from them tomorrow, and il try to update what they are trying to pull

Sorry to hear man. Im in Toronto and have had problems with my car but Nissan doesnt give a ****. I wrote a letter to the HQ and got a reply back saying they could do nothing about it. I phoned up my dealer (the guy who sold me the car) and he happend to be a really nice guy and basically told me to bring the car in, under his name. Well, he hasnt done it yet, but thats his plan. He was telling me that Nissan shouldnt be doing this to me, and im his customer and he'll treat me right, blah blah blah. So.. Hopefully everything goes alright for me.

Anyways, call up the guy you bought it from and ask him honestly, what do you think i should do? And if he replies with BS, ignore him.

Other then that, GL. There is no lemon law in Canada, and theres a 0.99% chance of them buying your car back because of the no lemon law. Although it can happen, visit http://www.camvap.com I think thats the site i was going to go to.
