Back in 01 there were a series of memos between Dept Assistant Attorney General John Yoo and the President of the United States of America. These documents(from which we only know excerpt) were written at the specific request of the Bush administration. These memos aimed at setting up the legal platform from which to launch domestic spying operations and interrogation methods to be used in the war on terror.
Both of these memos originated from John Yoo's office. He acts as the presidential 'go to' guy for all things legal.
Memo the first..
"Our office recently concluded that the Fourth Amendment had no application to domestic military operations" Was the footnote from a document titled 'Authority for use of Military Force to Combat terrorlst Activities'.
Memo number two..
"Our previous opinions make clear that customary international law is not Federal law & the President is free to override it at his discretion" .............. "Finally, even if the criminal prohibitions outlined above applied, & an interrogation method might violate those prohibitions, necessity or self-defense could provide justifications for any criminal liability"

This is strait from the executive branch of our government basically saying that the Constitution as well as international law is meaningless as far as they are concerned. In addition, the last line is simply disturbing as hell. Do you guys understand the implications of the last piece of that memo? They set up legal grounds for torture.. So their interrogators would have the means to escape any ramifications of their actions.
The Geneva conventions as well as the 8th amendment prohibit torture.
Congress has yet to declare war, so doesnt that mean bush doesnt have war time authority?
These memos are proof of international as well as US war crimes. Anyone using these memos as justification to commit acts of torture or unlawful spying is a criminal.
This proves that the events in Abu Ghraib, GTMO, and secret European prisons were authorized by high level people in the Bush administration, if not bush himself. That it had in fact been policy since the war started.
