If anyone has been following my story.. I was about to sell this car. As of now, i've needed 2 heat shields (understandable).. 1 exhuast midpipe since the welds broke.. 1 new speaker bc mine blew eventhough i don't play music loud often.. 2 new clutch pedals because of ridiculous noises coming out it.. and now the icing on hte cake.. my rotors have warped. The car has been in and out of the dealer countless times and i need to know the lemon law and what the details of it are. Any info or websites are greatly appreciated. Do you guys think i'll have a case with this? The car's got 8555 miles on it.

You will have a case...All you have to do is go to yahoo, search for lemon law and your state. As far as my knowledge, lemon law will cover you up to 15000miles.

i found some stuff but nothing exact. Like what specifications do i have to meet to have a case? They don't go around replacing cars because of a creaky clutch pedal or broken exhuast.. there's gotta be more to it damn nissan..

Strangely enough, as I was going through the Owner's Manual kit for my new Coupe, there was a booklet with the Warranty information and another booklet that detailed the Lemon Law in all 50 states. Each state had 2 pages on what to do, who to contact and what your rights were as well as the specific mileage allowed before filing a claim. Have you checked your Owner's Manual case for this booklet?

I know in WV you have to take it to the dealer for the same problem 3 times. However, you can only lemon law if they give you the same excuse three times. My STi had problems with the rear diff. It was popping and I had it looked at 12 times. I tried lemon awing my car and I couldnt because they gave me different reasons each time. Come to find out none of them were right. And because I had an aftermarket exhaust they always try to point blame towards it because it isnt there fault. Good luck with your case. I would do everything in my power for them to give you a new car if I was you. Cause we pay all this money for cars and they should keep up to the standards of the price not break down every 500 miles cough cough 2006 eclipse. p.o.s.

I just skimmed it, but it seems that your car qualifies as a "lemon" in the state of New Jersey if it has less that 18,000 miles AND has had the same issue repaired three times OR has been out of service for 20 cumulative days.

I would assume that you may fall under the "out of service for 20 cumulative days" item here. Understand that your blown speaker doesn't count as "out of service", but your clutch problem, the exhaust issue, the rotor problem and, quite possibly, the heat sheild issue could all count towards the cumulative days out of service. Even though you may be able to drive on the bad rotors, it's legally unsafe to do so and you could be cited for doing so, therefore this can count as "out of service" (your car was not "roadworthy").

You may want to read up on the site I linked above for further clarification. It also stated that you have to send the manufacturer a letter giving them one final chance to make good on everything. A template of this letter is even included at the bottom of the site.

I would NOT suggest you go to the dealership to complain. This will only piss them off more. Just send written letters via certified mail outlining everything they need to know. Threat of legal action will spur them more than someone going down there and complaining (although it really couldn't hurt to to so and may even make you feel better!).

I'm not sure because it's soo difficult to replace a car. Imagine if everyone with these 'minor' problems demanded a new vehicle. I don't even think it's been 20 yet.. but th edealership is far i can't keep driving down there and having people take me back and forth. idk what to do with this thing.. probably gonna get everything fixed and put it up for sale and see how much i can get for it. anyone gimme an idea about how much ill get. 2.5s.. convenience package.. 6 speed.. (intake and wheels but that doesn't really count).. 6 speed has a long waiting list also.. so what do u guys think?

I'm a master tech at a nissan dealer in wisconsin and here to be under the lemon law you have to have come into the dealer three times with the same complaint.

And relating to the problems you are having, the heat sheild has a recall on it, possible already done before you got it but i'll tell you the way they made them is stupid. flat out retarded i have no idea what they were thinking.

I personally have a 2.5 s model with a 6spd and i have a clutch creak as well, but it's not the pedal it's the slave cylinder, i have replaced it already but it just comes right back, i haven't had the time to see if there is a way to modify it. You haven't said anything about it but on mine i also get a creak/groan from my seat belt, i have replaced that too and it comes right back, i have been trying to get in touch with our tech department to figure out how to resolve these "flaws" when i find out i'll try to pass them on to you.

here i'll tell u from the second i got the car what's gone rong:

1) strange clicking from the rear right side of the car.. probably from warped rotors. Dealer said cannot replicate problem. took the stupid tech with me and it was CLEAR AS DAY and he said its just rust build up on the rotors or some crap like that

2) clutch pedal got stuck and made creaking.. dealer gave me hell then finally ordered me a new pedal (forgot the name of the part)

3) glove box made ridiculous noises when it was cold out.. took to the dealer.. couldn't replicate the noise when it was clear as day once again

4) revved at 2000 and heard a noise (heatshield).. took me 2 times till the finally acknowledged the problem bc it was before the recall and they didnt know

5) seat creaked like a rocking chair in the cold.. seatbelts did as well.. took it to a different dealer. got there and they told me the heatshield was never fixed and they gave me a brand new one (or so they say).. told me they couldn't do anything about the seats and i'd have to deal with them unless they got much worse

6) in 3rd-5th gear at very very low rpms.. loud rattle was heard.. went to the dealer and they told me they couldnt hear it. so i got pissed off and took them for a spin.. he heard it.. diagnosed it and told me my exhuast welds on the midpipe broke. HOW DO WELDS ON A NEW CAR BREAK!? part's on back order for 2 months

7) clutch wont stop making its stupid noises so i took it back.. had to call nissan headquarters to argue because it was becoming ridiculous

8) on my way back.. realized the right speaker made a weird noise whenever any song that had a little bit of bass came on.. so i lowered the base to -5 and it wouldnt go away.. very very audible crack in the sound.. told the tech and he told me they'd give me a new speaker (as if it was some sort of favor)

9) took it for vacation and got stuck in traffic so the brakes heated up a bit.. hit the brakes a bit hard and the squealed like hell.. finally got outta traffic and hit 75.. had to brake when more traffic came and the car vibrated like crazy.. didn't even bother with nissan took it to the local autoshop firestone.. they told me my rotors are badly badly warped.. called the dealer and they told me to bring it in.

so.. so far i've had problems with my brakes.. exhuast.. sound system.. and clutch pedal. all that's left really (major parts) is the headers.. motor.. and intake..

oh ya. and during hte 'complimentary' washing of my car.. i got a nice loooooonnnggg scratch on the back bumper AND when they did the inside.. they scratched up the plastic that houses the odomoter and speedometer which gets annoying at night when u can see them clearly..

wow sounds like you go to one really sh*tty dealership, we would have just replaced what ever you were having a problem with, if we couldn't hear it the first time we'd send you on your way, but after that we would replace it to make you happy had we heard the noises or not, but you should have gotten a letter from nissan asking about your visit so please score accordingly

yea theres no way in hell im buyin from our dealership now haha ill go toward old bridge, i know theres one around there. you can use my ebay account if you plan on selling, there are a lot of buyers on there and not too many coupes
