Kovarbasich trial is a joke

I haven't heard most of the trial but I will give the key points I have heard.
16-year-old Daniel Kovarbasich was convicted of voluntary manslaughter and aggravated assault. He hit Duane Hurley over the head 3 times with a pickle jar and then stabbed him over 50 times.
-He calims he did it because of years of sexual assult.
-They can't keep the story straight. It is very possible he is lying.
-There is no physical evidence.
I was laughing listening to him speak. They started by touching eachothers penises and masturbating and then it eventually turned into oral and later on anal sex. He never said anything about being forced to do it. Heres what got me...He said he did it because Duane GIVES HIM STUFF and because he wanted to drive his Corvette. Um last time I checked that's called prostitution. He wasn't forced to do this. He did this because he wanted stuff. And it looks like he is going to walk...f*** unbelievable. He looks like a sociopath. Look at his eyes...he looks crazy.

Reserved for people with a violent past? You mean like stabbing someone over 50 times?
Mentally his brain is developed enough to understand what he did. Mentally he is not a child. I don't care if Hurley was a child molestor. GO TELL SOMEONE! Don't stab them 50 times dumbass. Rot in prison.

a 10-year-old, fine but a 16 year old? There is no difference between the ability to make a decision and understand the consequence, between a 16 year old and a 21 year old. True the brain is not fully developed until the ages 23-24 but it is capable enough. He knew what he was doing. He was not forced to do anything. He said he really wanted to drive the corvette. How is this any different than a 16 year old girl walking the streets, preforming sexual favors for money? Is it a crime if I seduce a 21 year old girl at the bar with money or my car? How about using a rocking body? If we go back to my place and have consensual sex does she now get to stab me 50 times?

I don't support what Hurley did to him but he should go before a judge. What would happen if everyone got to go and kill someone when they or a family member were seduced, abused, raped, assulted, murdered. Daniel had much more of a choice than most people in those other things I listed.

And that is why the courts have to make a special ruling to try a 16 year old as an adult. Even though at 18 you are finally considered an adult. You can’t simply apply a scientific standard across a range of ages and then proclaim guilt. Children do develop at different paces and ages.

It is nice that you can peek into his mind/heart and determine his guilt. That would make you God.

The problem with this case and your hypothetical is that this guy who was 55 seduced a minor. This goes well beyond just picking up a girl at a bar and she stabbing you to death.

I did a paper on just this issue. The research shows that even though physical development varies, mental development is almost the same in boys and girls. Maturity can vary a lot because this is based on upbringing and experience.

I don't have to see into his mind because he is sitting on the stand telling it to me. Unless he is lying?

Oh and by the way there was not physical evidence to support anything he said. He told one story to the police, another to his parents, another to a physchologist, another to the court, and finally his final story to the court. They just spent 5 minutes listing all the things this kid lied about. There is not once thing to suggest there was anything sexual involved.

Also I missed it but they said something about classmates voted him most likely to kill someone...that's not weird...

I am not arguing his innocence or guilt. But in my book a 55 year old person that is messing around a 16 year old is a scumbag.

Funny, the defense actually just used the word prostitution in their final statement. They said what you said above. The guy is a scumbag for messing around with someone under 18. They did imply it was a form or prostitution though. Either way, after hearing the closing or final statements, he should be locked up for a long time.

Well, yeah. Halfway houses, required classes/programs, drug rehabs, stuff like that can be imposed.

But, 5 years probation is what it is. Which is, a light sentence relatively speaking.
