Issues with my '06 M35X

I hope you guys can help me on this one. As stated, I have an '06 M35x with just 14,000 miles. The problems I am going to describe have been occuring since I bought it with 3k from a reputable dealer south of Indy. First, there is a pretty loud "clunking" sound when shifting from 3rd to 4th in manual mode while accelerating quickly. The dealer says they drove another M35x and replicated the issue, they are also trying to tell me that this is normal and only happens when shifting above 4500rpm's. They told me that I shouldn't shift after 4500 because it is out of the torque band, is this one of the dumbest things I have ever heard or am I the dumb one? I buy a car for 45k and can't even utilize it to it's fullest potential?!?! Anyone else have this issue? Second issue, again when accelerating quickly there is a very low, somewhat subtle rumbling/vibration. It is noticeable to everyone I have ever had in the car but not to anyone in the service dept. at my dealer. Anyone else have this issue? I am really trying to be understanding about this but it is hard when you write that big check every month and your not completely satisfied. Welcome to NICO.

Yes, this specific issue has been seen by others ... please do a search for the posts here that talk about this clunk from the transmission. I forget what people have to mitigate or resolve the problem

(BTW, telling you not to shift above 4500 rpm is a silly response from the Service guy for sure.)

I would suggest starting up the chain to get resolution. Call the Dealership Manager and/or the Owner. Follow that up with a call to Infiniti Corporate folks and don't take no for an answer.
