is this e brake mechanism on 1 caliper fixable?

So my driver side caliper was not locking with the e brake so I took it off and I'm stumped. The lever is all the way as if the e brake was on but it's not in this pic. And if I push it back down them the piston comes out. How did this happen? Can I fix it or do I need a new caliper?

may have broke internally, they are cheap. when you pull the cable, it moves the lever on the caliper but the piston does not come out?
