Hi everyone,

I found this forum while lying in bed with icepacks and pain meds, but I am getting ahead of myself.

I purchased an Indigo Blue Rogue SL at the end of Feb. 08. I absolutely love my new car. So refreshing after years of minivan driving! My sweet car was 12 days old when some jerk smashed some windows in my car and stole my purse while I was at the gym, at 8:30 am. After sitting in the repair shop for 8 days, I got my great car back!

Like many fellow posters, I baby my car. At 4.5 months old I was fortunate enough to not have any door dings, or scratches. Until last week....While sitting at a stop sign, an older model cadillac plowed into the back of my car going in excess of 40MPH. The offending driver said that she did not see the intersection or my car. Have you seen how bright the Indigo Blue is? Anyway, she was carted off to jail, no DL, no insurance, disorderly conduct, running a stop sign, failure to maintain control, etc., and I rolled away to the hospital. Fortunately, my injuries will heal, but I am still waiting for the status on my car.

Any advice out there? I have never been in an accident before, and have never had to deal with insurance companies, I am so worried that if they repair my car that it will never be the same. I should note that my husband and I hang onto our cars for about 8 years. We hate car payments, so we try to have cash saved up whenever we are ready for a new car. Any thoughts or advice would be greatly appreciated.

What a bummer! Well, being hit from behind at 40mph, you should thank your lucky stars, or whatever, that your injuries weren't worse. If the airbags inflated it's likely the car will be declared 'totaled'. That's what happened to our CRV. That's how we ended up buying the Rogue. Don't sign ANY release forms yet. Hopefully you took photos of the accident....from all angles. Be sure no physical problems show up after a month or so......especially neck pains. Document any citations issued by responding police. Note weather conditions. Your insurance provider will definitely raise your premiums because of the accident. Fault is not a factor! Shop around. There will be a lower premium out there. Best of luck. Hope all works out well.

Thank you for your comments. We do have pics of the car and of my injuries. I suffered a broken nose, lateral whiplash, back sprain, broken hand, and many bruises. My insurance company was concerned that the air bags did not go off. With such a violent hit, I expected some of the six airbags to deploy! I should find out in the next day or two about the status of my car.

I am concerned about our insurance rates. We have a teen driver also on our policy. Fortunately, this is the only claim we have ever had against our policy, and also clean driving records for all three drivers.

Is anyone knowledgable of the parts that could have been damaged that I need to be aware of? Maybe something that is not immediately apparent. Also, I am trying to educate myself about repairing unibodies, and crumple zones. Any help would be appreciated.Thank you

When I totaled my Scion TC last year my insurance(Allstate) was going to fix the car in the beginning. But after the estimate since the cost was over $10k but the car cost $15.5k they just paid everything off to me except $500 deductible....they paid taxes as well. Allstate never raised my premium they even lowered my insurance for $100 after all. I had no injures and I didn't hit anybody. That was my first accident but didn't have any tickets for over 3 years...(too bad got 1 last week). Anyway it depends on whose fault as well as it depends on your driving history. All they worrying about paying your medical bills and someone else bills. The car.....is just a piece of metal. You will buy a new one if they won't be able to fix it. They will tell you right away after estimate.

The collision was the other driver's fault. I was sitting at a stop sign, and she never touched her brakes. She hit me going in excess of 40 mph.

Unfortunately, she does not have insurance, drivers license, or a job! So far my insurance has been great. My medical bills are being covered, rental car is being provided, and they are currently doing a tear down on my car. I am praying that it will be totaled. I bought it at the end of Feb, and just turned 4K miles. I'll keep you posted as to my outcome!

Please do. Your accident sounds almost exactly like mine, except that I was stopped at a red light in my Camaro and a lady in a Mustang was talking on her cell phone and didn't realize I was stopped at a red light. She plowed into me at 25mph and pushed me into the Honda Accord in front of me.

Her insurance company was going to fix my car, but the damage to the frame was severe enough that they totalled the car. I thought it was fine because I drove on it for the 12 days after the accident it took Geico to even look at it. (The airbags on my car didn't deploy either.) I wasn't counting on it being totalled so I still had stuff in it and I had to go to the junk yard to get it all out of my car. I don't want to ever have to do that again. It's kind of like going through a dead relative's pockets to get your keys back.

Anyway, I had whiplash and back trauma from the accident. The neck trauma went away, but six years later I'm still hurting in my mid-back. I wish you the best of luck.
