So a pickup nailed me from behind causing $15k in damage. Because I was down in fl. (from ny) Geico gave me the speech as to why to use one of their certified shops. Meaning if there is a problem I can just take it to another geico shop in ny.

So after 6 weeks I got the car back and to me it looked like they did a decent job. I brought the car to an infiniti dealer to have them look it over, and as it turned out they did an extremely sloppy job. THe trunk was not alligned the gaps on the trunk as well as the rear bumper was totally off. The tail lights and the small rear windows werent flush etc...I brought it back and they promised they would fix it.

Anyway my question is when I return the car, can/will they say i owe them money b/c it was in accident therefore depreciating the value?

Welcome to NICO.

Geico should pay you a diminished value amount on the car in addition to the repairs. I would put this away in a savings or CD and hand it over to Infiniti when you turn the car in.

Tx for the welcome. From what i understand geico does not pay out for diminished value. Do you know what usually happens in a lease situation, thanks.

I had a 4runner which I did a big 'My bad' to it years ago... I called toyota and asked the same ?

They told me that nothing happens/// as long as the repair job is a good one:)... The only thingbis that if I had extremely low miles... And had equity in the car at timenof return; the accident would offset the equity, and I'd get nothing.

So ur ok, u wouldn't have to pay ( sounds likenthe repairs are ok)... L

Ps . I'd call infiniti, and ask them to confirm though, cheers

Welcome! Diminished value claims vary by state and in your case it would be the state the accident happened in. No insurance company is going to voluntarily offer to pay DV except in Georgia where it's mandated. That being said, you have an even better case because you went to one of GEICO's gecko shops. If you went to your own shop they would claim the DV is due to your repairer's inferior work and not the accident. However, in your case, they will have to bite the bullet as they are the guarantor of the work quality. Two things to consider:1. Income Tax Deduction ? ? ?Yes - IF you itemize your deductions, use Line # 19 of Form 1040 - Schedule “A” to Deduct your unrecovered Diminished Value. Assuming you have an unrecovered Diminished Value of $ 2,000 and a tax rate of 20%, you can Reduce Your Tax Obligation by almost $ 400.00 - well more than the cost of the Diminished Value report itself - You can even Deduct the Cost of the Diminished Value Report on Line # 22 of Schedule “A”.

2. Get professional advice from a company that is experienced in handling DV claims. They will be cheaper than any freakin lawyer and know the ropes. Google "Diminished Value Claims". Here's one example (I do not have any experience with them - just an example)

Good luck

JackO, I spent 30 years working in the property and casualty business, specifically in the auto physical damage end. I've tried to get back in the business after taking a lucrative buy-out, but all the companies age discriminate like crazy today. Hopefully, I can offer some free advice to the members of this great group when they have insurance or collision repair questions.

PS I think this member may have a real good case, his biggest obstacle is that the car is leased and he doesn't really own it. The statute of limitations runs for 7 years in most areas, so if he gets bagged when he turns the car in, he could seek further damages. In the meantime, I'd just keep bringing the car back till it was perfect at GECKO's expense.

Why not use the 30 years of experience for your advantage. You should open your own business.Advising and working with clients against insurance company sounds like a good idea. For you anyways for the insurance camponies well they got what they deserv. hheeheh

So now its been 2 weeks since i returned the car for the m to fix. They give me half-azz excuses as to why it is not ready. "Paint guy didnt show up", "lost power the other day" etc...They are however paying for my rental, but still this is messed up. I still have to pay the leasing comapny, is there any recourse i can take, again I got into the accident july 13. THanks.

I got my insurance question answered, ty for the replies.

Update and new question.

Ill give you the cliffnotes first: Should I be hearing some wind noise in a brand new g37 driving at 80 mph?

So I brought the car back to the shop (geicos) with a list of about 20 things that the manager at infiinitis shop pointed out to me. 3 weeks later I pick up the car and everything on the list was done.

I get the car on the highway, get it up to like 80 mph, and I start to hear a slight wind noise. Obviously it bothers the chit out of me, so I bring it back, wait 3 hrs while they readjust the window, give it to me and say it is fine.

Of course when I get it up to 80 again I hear the wind noise. Bring it back later that week, wait another 3 hrs, the production manager works on it, tests it, says he hears the noise, and suggests that they order and install new weatrher stripping.

Just get the car back today for the 4th time, the stripping didnt help. Call the mangaer of the supervisor at geico, and tell him the story, and that it is unacceptable. FWIW he was very understanding. I told him I would like to bring the car to the shop that infiniti uses (the guy that originally pointed out how sloppy of a job they did). He seemed cool with it. I then get a call from the managing local claim adjuster explain to him the story.

He says," Well in my car I can hear the wind at 80 or so" .Im like "wtf"! I tell him (not knowing if this true) that these cars should havew no wind noise, even at 130 mph, and that it is totally unacceptable. He said he will call me today after he speaks to theri shop.

So the question, should my 6 month old g37 have any wind noise at 80 mph?

Thanks.

No Wind noise at 80 or even at 120!

Get them to fix it right or get them to give you a new car!
