dont know the rules in fla but in ny...leaving the scene of an accidnet involving more than 1000 property damage is a crime "leaving the scene of an accident" and should be filed with the police.if filed...the police may then investigated with security at the mall...if there is a video tape of the area...that tape should be pulled.ur damage comes down to one thing....the paint work...how well can your guy do it...black sucks to match, and im gonna guess ....1500-1700..for it to be done properly..now you have a choice judging if they do not get the loser how hit you.
i am speaking from the ny side of things with ins policies...
what is your deductable? the amount you need to pay as part of a damage claim?
you can use your deducatble here...which means...if you have 1000 deduct,,,you pay 1000 and your ins pays the rest...now...unfortunatly...with ins companies..they hate to pay anything..and will in some way get it back..in the form of policy increases.....you may find your insurace go up slightly on you next renewal...it sucks but its a fact of life.
or
depending on how far you from the deductable and the actual cost...pay it ur self and dont file claim...if the damage is closer to the deductable amount..what u have to pay any way....id pay it my self and leave my ins out of it...it leaves my record clear...and gives the ins company less reason to raise u or even drop you if you god forbid need them for something bigger...they dont care about it not being a big accident or if it wasnt your fault..they see money coming out of their pockets...
