I've searched the forums and havent found a problem quite like the one I am having. The third brake light on the hatch kinda works when it wants to, i have replaced bulbs, fuses, the assembly its self the connectors going to the assembly and bulbs but its still not right. when the hatch is fully open the brake light is off but if you lower it about halfway it comes on... works fine, if i shut the hatch lightly it will still be on but then after a while it will stop working. If i slam the hatch it goes out, so i beat on it a little bit and it came back on. I have jiggled and pulled at wires with the hatch opened at different angles.. no difference in light being on or off so i dont think its a loose wire, is there some sort of tilt mechanism or pin switch around the hatch? or maybe something to do with the latch? Just looking for it to function properly. Any help is greatly appreciated. Thanks.

Sounds like a broken wire going out to it, or a poor ground coming back. No corrosion in the socket? Broken bulb filament?

what.... i thought the 3rd light was an option? so if dosent work it dosent realy matter if you have your two main brake lights working fine.

Third brake light are mandatory on all car's manufactured since 1986. My 90 pignose's third brake light has never worked and i have yet to have any problem with the police here in nyc.

If your hatch has gone the way mine did from age and use, pull the rubber grommets that house the wires.

The harness comes down the passenger side, and main power goes down the driver side. The grommets are located near the hatch hinges.

My wires just got worn over time, and a couple frayed. My power wire on the driver side was completely severed. The grommet was kinked as per normal, but not torn.

Anyways, your problem is most likely here since the light works at varying stages of the hatch being opened.
