Guys Help Me, my car is impounded and i only had it for 2 weeks..

Hey saturday, i got caught for DUI whcih wasnt my fault b/c the police Bull shtted me. I was sitting in the driver side seat with the keys out the ignition. Anyways, they locked me up for DWI. They took the car and impounded it and i have to wait untill Jan 14 08 untill my court date. Has anyone ever been in a situtaiton liek this? The car is currently being financed thru a dealer. They will hold the car for about a month and a half.. I asked the police if i can get the car back and they told me thati have to wait untill my court date. What should i do guys? Has anyone here been in a situtation like this? Is there anyway i cant get the car back now since its being financed? Plz guys all help is appreicated. Thanks

Well, I'm not sure how the law works where you are, but in Cali, it's considered a DUI even if you had the keys out the ignition and you were just sleeping in the car. In order to avoid that, you need to toss the keys into the backseat (I learned this when I took a class to avoid getting a point on my license when I got a ticket). Unfortunately, the law doesn't care whether you're financing the car.... Hopefully others may chime in with the same experience or knowledge of what you can do. But you should try the key tossing thing next time. Good Luck bro!

Did the police perform a breathalizer test & if so what were the results?

Getting into a motor vehicle after drinking can result in your spending time in jail, loosing your license for up to 10 years & make you unemployeeable.

damn..i feel helpless man..i just hope to god i dont loose the car. They told me its considered as a misdemeanor and since its my first offense shudd i be able to get off? THis sht just worries me..i just got the car and now this..

you shouldn't get your car taken away on your first offense but you will get your license suspended.

You need to get a lawyer ASAP. If you think it's expensive now, just wait until you try to get a new job and they run your background check.

Get a lawyer. I've never been through anything like this but I watched my ex-wife get out of jail time for 2 DUIs in 6 months.

I'm sorry to hear you are in that situation (AS LONG AS YOU WEREN'T DRIVING) I used to tie one on in my day and I always slept in the back seat of my Acura Legend at the time... Since you have a lienholder on the car, then they cannot keep your car forever... different story if you own the car free and clear... the arresting agency can impound your car and keep it for their own use forever! You need to get on the horn with a good DUI attorney TODAY! NOT TOMORROW! If your story is true and that you were not driving, then the judge should have some leniency on you as well as this being your first offense, but still have an attorney. Arizona recently changed it's DUI laws so that ANY DUI conviction results in 6 months suspended license and MANDATORY 45 days in jail... no if's ands or buts...

In a similar topic, I've wondered when this subject would come up about the keyless cars... Not sure how the law is going to change because of keyless cars... even though I throw the FOB in the backseat, the car can still be operated... I'm sure this is going to be tested in the courts, because If I'm just "sleeping it off", but my car will still work, then technically it is a DUI...

Sorry to hear 'bout your misfortune, but the best thing for you to do is learn a VERY Valuable lesson from this and don't think that your life is destroyed, because this too shall pass. Be professional and grown up about it and chalk it up to a life lesson that alcohol and vehichles never mix, even though you may not have been driving. Keep us posted.

After reading your story again, I'm a bit confused... did they charge you with a DUI or DWI???? There is a big difference in many states... Your new lawyer will be able to answer your particulars, but most states have lesser penalties for DWI rather than DUI... important to know. Consider yourself very fortunate that you made the right decision by sleeping it off in the drivers seat... I would much rather deal with the punishment of your situation then have to live for the rest of your life with the knowledge that you killed someone like in Telcoman's link... count your blessings and don't forget about that lawyer.

I'm sorry to hear what happened to you but as others have written, you need a DUI Lawyer ASAP.If you are a AAA member perhaps they can give you some advice?If you have a cell phone and calls were made around the time you were in the car but not driving, a good attorney should be able to plea bargain for you with the prosecutor that you were waiting for someone to come and drive you home? The fact that you were not operating the vehicle is a plus in your favor. The cost of the lawyer, points on your license, probably a huge increase in automobile insurance as well as insurance surcharges may result in you having to get rid of your G and drive something cheaper. Your credit rating and credit score will also be affected. You will be paying higher interest rates on any credit cards or any money that you borrow. That is why getting a good lawyer is so important. You do not want a DUI conviction on your record.

If you are under 25 you definitely want to get rid of the G because having a 300 HP vehicle is going to cost you bigtime $$$$$ if you are convicted?.

Do we hear Honda Civic?

Do some research on DUI in NJ and lookup the statue on your summons.There was a post awhile back for someone who got pulled over for doing 130 MPG or something like that. We haven't heard from him lately?Consider yourself lucky that neither you or anyone else was injured but it only takes one second of stupidity for someone to ruin their life or someone else's forever.

Your lawyer will speak to the judge for you. Perhaps you can visit a few high schools as part of community service & tell these kids who are chomping at the bit for their drivers licenses what happened to you and what it is costing you so they don't make the same mistake.

Be thankful you are not in jail.

Just found this. Maybe this will cheer you up a little?

Recently a routine police patrol parked outside a bar in Wisconsin , after last call the officer noticed a man leaving the bar so apparently intoxicated that he could barely walk.

The man stumbled around the parking lot for a few minutes, with the officer quietly observing. After what seemed an eternity in which he tried his keys on five different vehicles, the man managed to find his car and fall into it. He sat there for a few minutes as a number of other patrons left the bar and drove off.

Finally he started the car, switched the wipers on and off--it was a fine, dry summer night--,flicked the blinkers on and off a couple of times, honked the horn and then switched on the lights. He moved the vehicle forward a few inches, reversed a little and then remained still for a few more minutes as some more of the other patrons' vehicles left. At last, when his was the only car left in the parking lot, he pulled out and drove slowly down the road.

The police officer, having waited patiently all this time, now started up his patrol car, put on the flashing lights, promptly pulled the man over and administered a breathalyzer test. To his amazement, the breathalyzer indicated no evidence that the man had consumed any alcohol at all!

Dumbfounded, the officer said, I'll have to ask you to accompany me to the sheriff’s office. This breathalyzer equipment must be broken."

"I doubt it," said the truly proud non-drinker. "Tonight I'm the designated decoy."
