Got the Runaround!

Well back in January, my dad bought my bro his 300zx from this independent dealership. you know those small ones. anyway, my dad bought a very good cond. 300zx tt 5-speed t-top for only 5k. the paint was flawless and no damage except for a mark on teh drivers door. Well the guy who sold it to us said he mail the papers to us when he fixed the stuff with the DMV. well It has been 3 mos and still no progress! My parents want a refund bc he has not complied to do his part so we can register the car. without the documents that we need, which he has, we cannot register the 300zx. My mom has decided to take him to small claims to get the 5k back. We have never driven it. it justs sits in our garage collecting dust. The thing is my dad paid it cash, dont ask me why, and the contract has the sellers company on it (its his company) but he didnt wrtie his name on the contract. Think we stand a chance in court?

...if you have a bill of sale and a signed contract, then you shouldn't have a problem. If you only have a bill of sale, it could be a little trickier, but in California it's the buyer's responsibility to take care of the paperwork. You might want to call the DMV and have them check the VIN to see exactly what it is that's wrong with the registration, and go from there.

The laws in GA may be a little different, but I can't imagine much.

A dealership has 30 days to get you a title and get the car registered(if they are doing it). If not there is a $1000 dollar fine. Call up your local state body that regulates and licenses car dealership and see what you can do about submitting a complaint and hopefully having them fined. Also take them to court. Because they did not come through with the paperwork as promised and required by law the judge will do one of two things: require them to refund your money completely or require them to turn the title over immediately.
