Got pulled over for a modified exhaust

Hey stillmatic,Where were you visiting. Sounds an awful lot like my area.Wouldn't be in the southern Ventura county area would it?I had two of my friends get pulled over for noise violation and no front license plate, both on the same night about an hour apart and literally 3-4 blocks away from eachother. -Jeromy

Yeah I had the same question, cuz it kind of sounds like something that Fremont cops would pull. The cops in fremont/Milpitas are pretty notorious for pulling over modified imports...

It was in South San francisco in nor cal. Gotta watch out for berkeley cops too. The bay just isn't safe no more.

Oh yeah, I just found out today that my friend who was a cop in training is now an undercover cop. He came to my house earlier with a brand new Buick. It looked just like a regular car with hidden sirens and strobe lights. I actually thought I was getting pulled over again because I just came from KFC to get something to eat. He told me he a saw a honda trying to race on the freeway and he turn his lights and sirens on him... The guy pulled over but my friend just laughed and went straight because he just wanted to scare the guy.

Read the vehicle code. The law has been changed twice in the last few years in California. First they more clearly definced the law so that yor car must be making more than 95 dB based on the SAE testing procedure. Then they changed the law so that now there will be the opportunity to have your car tested by a referee for noise. Here's an exerpt from the SEMA Action Network Newsletter.

"WASHINGTON (Sept. 19, 2002) - Thanks to a new SEMA-sponsored law, California automobile hobbyists are now better equipped to fight unfair exhaust noise citations issued by state law enforcement officers. Legislation recently signed into law by Governor Gray Davis to provide for a statewide exhaust noise testing program will allow motorists to prove they comply with state noise standards.

The new law requires smog check stations that provide referee functions to perform the test. These referee stations will issue certificates of compliance for vehicles when tests of their exhaust systems demonstrate that they emit no more than 95-decibels, under Society of Automotive Engineers (SAE) test procedure J1169. Only those vehicles that have received a citation for an exhaust noise violation will be permitted to submit their vehicle for the test.

The law also allows courts to dismiss citations for exhaust systems that have been tested and for which a certificate of compliance has been issued. Fees charged to motorists for the certificates of compliance will pay for the testing program."

It's funny. The same month that Gray Davis got impeached, I didn't have to pay my engery bill because I had a credit. Keep in mind, I've never over paid my electric bill.

With regards to exhaust, I had to do some research on the California Vehicle Code sections a couple of years ago. At the time, there were three seperate categories for passenger vehicles, trucks / vans, and motorcycles. The three sections were also split into two categories, pre and post 1973.

The measurements had to be taken at least 200 feet from any intersection or major street, and with some other provisions that I forgot.

Basically, the most that the cop can do is say that he believes your exhaust is out of spec, and have you tested. Anything more than that, and a competent judge should throw it out. Especially if it hasn't been tested.

Now, when they send you to the test station, that's a whole different story. In theory, they should only be able to test your exhaust. But who says, since you're there, that they're not going to just check your smog equipment too, or whatever.

can anyone beat this? I got pulled over around 12am for unbearable noise (exhaust) then he gave me a ticket, I said to myself, ok well time to go home, I turn around and start to head home and 2 blocks away a police sees me and makes a U-turn and pulls me over and tells me that my exhaust is too loud, so i tell him that i have JUST gotten a ticket for that so he gets mad and tells me to hurry and go home...... so i proceed to go home and in about 15 minutes later i get pulled over AGAIN! for the exhaust... haha by that time it was funny how they couldnt really give me a ticket again so i just drove about 5 miles at 4500rpm =)
