Got my 1st Speeding Ticket...need help guys!

Hi all,

First of all, let me preface this by saying - I messed up, I was speeding, and I got caught. I'm not contesting this. It was my fault, and none other's. What I'm asking now is advice for damage control, if you like. Also, I know a great number of you reside in KY, which coincidentally, is where I got caught.

Basically - it happened like this. I was on I-75 north last night around 7 pm in Boone County (Florence) KY. I came over a hill, speeding, and saw a trooper sitting in the median; lights off. I didn't have enough time to slow down, and well, he got me.

He told me he clocked me at 79. I told him I really didn't know how fast I was going (I really didn't - but I thought I'd been going faster than that). Anyways, the officer was very polite, as was I, but nonetheless, I got cited. He wrote on the ticket that I was clocked at 79, but cited for 70 in a 55 zone.

Seeing as how this place is at least 3 hours away from where I live (only when I'm grossly speeding) I called this morning to find out what my options were. The lady at the Licensing, etc. dept. told me that since I was out of state, if I paid the full amount before the due date the points (3 points she said) would not transfer to Tennessee, and that my insurance would not be affected (or even know that I got a ticket). Essentially, she said I would not need to go to traffic school if I paid the ticket.

Now - does this sound right to you guys? I have no problem paying the full amount of the ticket - so long as my insurance company doesn't get wind of this. I asked her repeatedly to make sure - and she told me the ins. co. would not find out.

KY people, and everyone, am I missing anything here? Please let me know. This is my first time dealing with something like this.

many states dont have reciprocal agreements and points dont transfer over.

This is independent of wetehr you pay in full rigth away or not.

If you contest it should still not transfer.The ONLY way for your state to find out is if you plead guilty or dont show up to court(=guilty) and then fail to pay.

The above is based on my experiences involving different states.

Your insurance agent ( if he is experienced) will be able to give you advice with greater certainty), and dont worry about telling him about teht icket, he is <your> insurance agent and works for you <not> for teh insurance company.So telling him wont inform them.

hmm...i never knew the law was like that. is that for most states? for example i live in CA and if i were to get a speeding ticket in Vegas it wouldnt count as any points and my insurance wouldnt go up? if this is the case i can speed my way all the way to vegas once i get out of CA boundries.

This is just out of curiousity.

i c thanks i have to look into it, hehe, if it is true, than trips to vegas will no long take 3 1/2 hrs, hehe i might beable to make it in 2 1/2 or 3 :pface

You're going to cut 30-60 minutes from the transit time in the last 50 miles of the drive, when you're actually in Nevada?

I have about three tickets from that particular stretch of road and they are expensive. As far as I know it does not carry over for points but your insurance co. will find out. You could take a driving class.

Fred - I'll talk to my insurance agent next week. But what you said about the points transferring - if I just pay the ticket, am I not essentially "pleading guilty?" When I was speaking to the woman on the phone, she did ask me what state I was from - maybe KY-TN don't have an agreement?

Basically, I don't care about the points - my concern is the possible increase in insurance rates.

Your rates will likely go up. By signing for the ticket you are not pleading guilty but you are if you pay it. You would have to go to court if you want to say otherwise. Did I mention I was a cop for 5 years.

I've had two tickets and my rates aren't going up. I have to go to traffic school for one, and the other I just said sorry.

I have had 2 tickets out of state (IN and OH) and paid them both by the due date and my rates havent gone up, and i dont "think" i have any points on my license. But who knows... I asked a friend who is a cop in KY and he said that as long as you pay it by the due date you should be fine and he doesnt "think" it will transfer to TN but he isnt totally sure... I have also heard that states are trying to do a better job of making the tickets "transfer" to your home state, so im really not sure. Good luck, sorry im sure that didnt help much. I wouldnt talk to your insurance agent about it though. Id ask another company, last thing you want is your insurance agent raising you rates because of just asking.

We've all been there some time, but don't you think it's funny how cops always "give you a break" and still write you up for 15 over the limit? Then we're supposed to be happy that they only slightly put me over a barrel and had their way with me. Sorry I know that sounds off but if they really wanted to be nice then they would let you go since you still have a perfect record and all. Just venting...

Get a lawyer or talk with the prosecuter and see if you can get away with community service. Worked for me 2 years ago. Nick

fight the ticket. screw that crap about paying it on time and the points wont transfer, I'm pretty sure that's BS. If anything, pleading guilty would ALLOW them to transfer the points (if they do at all)...

seriously though, just fight it. I got out of both of my speeding tickets just by going to court with some bogus excuse. At the VERY LEAST you will get a reduction in the fine, just because the magistrate will try to bargain with you before you go before a judge. (thats how it works btw-- you talk to the magistrate first, then you go to court. If the magistrate is bein a hardass and you dont have a real case- just go with his bargain... ) it NEVER hurts to fight the ticket unless you're completely rude in court. I feel like the worst thing you could do is plead guilty and pay it right away.

Own up to your mistake, and take it. Ask the judge about the whole point thingy, and if it will transfer your points, do traffic school to negate it, if they offer it. Fix your mistake, and don't make it again.

I speed too, but I learned to slow down after getting 2 tickets within a month of each other, and I was fortunate they offered me 2nd offender traffic school (California).

Just take care of it.

Wow. Thanks for the replies everyone. I just got home after a very long drive. It's amazing how that 1st speeding ticket can make you slow down...

Anyways, I'd like to fight the ticket, or even go to traffic school - but still - the problem goes back to me living so far away. I just don't want to have to go through the hassle of going back there if I can just pay it and not have my rates go up.

With that said, I'm just going to talk to an ins. co. and see what they say about it. Worse comes to worse I'll make the long drive again and handle it in person.

BTW - how/why does an insurance company raise rates on you? Do they raise rates because they found out you got a moving violation, or is it because they find points on your license? Trying to find the exact correlation between raised rates and citations here..

Ask your insurance <agent> not the insurance company.your agent works for you.

I slowed down too... I mean, I still speed all the time, but not excessivly so even if I do get tagged by a cop he'll let me just go by. You said it yourself- it's amazing how the reality of that ticket can slow you down... it's always in your head now, if there is a cop over that hill or around that corner. Kinda sucks how you've gotta be scared of the man like that but I guess that's the way it works. As far as "owning up to your mistake" and all that crap, I say screw that. If you can beat the system and at least get a reduced fine then take it. I wouldnt go to court and try to argue with a judge if you really are completely at fault, but I dont think there is anything wrong with pleading not guilty and having the magistrate cut the fine in half just for you showing up (which is what they do, to entice you NOT to go to court cause that costs them money). Learn your lesson for sure, but I dont think you have to pay everything either.
