Got Into An Accident!!! (photos)

man....what a day.....came out from autozone with some paint to paint my new wing...on my way back.....i was on the street going 40....all of a sudden this lady with a x5 cuts in and brakes the **** out of the car...and then boom! i braked but too late....my wheels locked..(no abs sucks) hit her and my car went under hers....she had no damage except some marks that came off by rubbing.....but my car....hood, bumper, and the lights were bent....not really a big deal but still got to get it fixed....one question....this is NOT my fault right? lets say she takes this to the court....would i be quilty of anything? i talked to her about what happened and she admitted that it WAS her fault....man....i just want this thing fixed....and dont want to rip her off either...here are the pictures

*the third one was not from the accident but from running over a truck tire on the freeway*

You know what? You have the tightest chuki front I've seen on an S13. Regardless of the accident. My front bumper dropped 1/2" after a few years, and yours is still tight and cherry. I had a lot of gap and you have none.I suggest you try for another color paint though.

On the leagal note, you need to say these word exactly to your insurance company:

in most states if you hit somebody from behind you are at fault. You need to state this so you dont get charged with the fault.

Your front bumper is called Chuki.The gap between hood and bumper is very small, like off the nissan dealership floor. Very tight.

Did it happen at an intersection? Tell us the details. But what I'm gonna guess outta this is that it's gonna be on her. Was there any witnesses? Unless the repair bill isn't gonna be huge, let the insurance company take care of the money issue.

Well, actually, it does not matter where it happened. In the STATE mind you are suppose to keep distance, and once you rear end someone its automatically your fault! Thats how the whole insurance fraud started.

what happened was.....i was on my lane....(twon lanes)...im not sure what she was trying to do but she came into my lane...and braked....i think she was trying to make a left or something...about 2 feet before the left lane! thats why she had to come in so fast and brake right in my lane.... she DID say it was her fault so i guess its not on me....as for the damages....im going to take it to a body shop and get an estimate.....then contact her..hope it turns out ok...

if she's not shady, then you'll be ok. I say you get like a verbal confession or a written statement from her. I got into an accident 2 years ago and the guy who cause the accident tried to sue everyone, which was pretty stupid since there was witnesses to prove him wrong.

police report?

you need a witness or she could blame you. doesnt matter if she admitted it unless its witnessed. once she sees the repair estimate she could turn on you even if she seems nice. if theres skid marks get a photo. the courts will not take your word. try to avoid being held to responsible by insurance even if you have to write it off. likely to pay more in premiums in the long run than a new hood costs. most likely hold you partly responsible regardless.

court sucks

got an estimate at a body shop i used to work at....1440$$$ that is FIXING the hood and bumper....and replacing the headlight lids...and painting and matching and so on....so this is what im going to do....my friend can get me the hood and the bumper for 150$...same paint so no need to paint...then im going to get the headlight lids for 40$ and the hood lock assembly for 70$...thats 260$....then charge her 500$ total for both parts and labor....hows that sound?

I say you take it to a place that will do a really good job on your car. If her insurance company is gonna pay for it, make sure you're gonna get the best job done.

bad news guys....i think she's trying to make me pay for her car...which has noooo damage...im going to meet with the family tomorrow night...what shall i do? im thinking i should write out what happened and make her sign to proove that it was her fault...which i dont really think she's going to do...but other than that...i really dont have anything else to say....im in a situation where i can really get messed up or everything turn out well....man..this is some ****....as for the job....yes i do want to get to done professionally but im doing HER a favor...so that she can pay cash without the insurance knowing that she got into an accident...

but here's the thing....right after the accident....the lady and the son came out and we started talking...i asked for her information but she refused! not really like "refusing" but she and her son just didnt know what to do! i told the son because the lady couldnt speak english....tell your mom that ill get an estimate and call her (which i did today) then we can talk....so she gave me her number and they got mine...we're going to meet tomorrow night....man...i hope everything goes well.....

oh and other thing....if i dont get a paper with her signiture saying that its her fault, im screwed right? if she sues me saying that i just hit her....i can get pretty messed up right? what else can i get? there was one kid who saw the accident happen but she was gone when i was done talking with the lady....

You need her to sign an affadavit stating she was at fault for the accident. You made the mistake of not getting police involved. If someone just cuts in front of you and slams on the brakes trying to get over it's an "unsafe lane change" and they are at fault. Especially if they didn't use a turn signal.

To hell with being nice to people, they will just use you in a situation involving money.

Dude, you seriously need to get a written statement or something from her. Have the son translate if you have to. Also bring someone with you. Usually if you have someone there, you can sorta put intimidation in their minds, like "don't f with me lady" sorta deal. Yea, just because she seemed nice and saying she'll pay for your repairs doesn't mean jack when you can't prove she did it. Any person in an accident will jack your money any chance they can. Always get their info, and if they try to f you over, you let the insurance company deal with it.

Well, I can pretty much gurantee you she WILL NOT sign the paper. because basically, what she is signing is, Its my fault and come and sue me. Unless you release both of you of any fault. And write in that neither one can sue each other for any damages. But do not write this paper, you have to get a lawyer to write it. Its worth the $100-200. Because if you write this, according to law, she can still claim damage even if she released you from any claim. But there is a specific contract that can be formed, I just dont remember what its called. Trust me get a lawyer. It will cost you like $100 to make a contract.

you should've called the cops or something!

a month ago an F-150 pulled out in front of me and i t-boned him. 100 feet behind me was a cop and within like 10-15 seconds there was like 5-6 more cops, two fire trucks, and one ambulance! now thats service. they all told me it was his fault too and i got $1600 from the insurance company. had 2 witnesses as well in addition to the cop.

edit: btw he tried to blame it on me right before all the cops showed, and then he shut up lol.

just talked to her about an hour ago....she does NOT know what happened....she just got her license not long ago....man...her brother came out with her to translate and he was asking me if he can just pay me 300$ for everything....so i told her i couldnt do that....and then they wanted to cover it by insurance...so we traded both of our information and im just waiting on whats going to happen....but i can garantee that i am not paying for anything....it was totally her fault...and she knew it....well....just gotta wait...

I dont know if you made the right choice dude. Because according to insurance co, if you rear end someone its automatically your fault. :(

If she admitted fault at the scene of the accident, be sure to tell your insurance company. You have called them, right?
