got in an accident

got into an accident with my coupe today in San Jose. it was nothing major and no one was hurt... basically this is what happen.... their were 3 lanes. I was in lane #1. the signal was turned on to get into lane #2. waited while a few cars went by. see an opening and lane number 2 is clear. so we merge into lane #2 and a plumbing truck in lane #3 decides to merge into lane #2 and we collide in lane #2. I was in 1, he was in 3, and we hit in 2. had my blinker on for a while. coming from behind he had to have seen it. maybe some how he didnt see it. I have a 3.5se so I have blinkers in the mirrors to prevent this exact type of accident from happening. so had he even looked into the lane before merging, he would have seen the car across from him in lane #1 (me) was signaling to get into lane #2. so I guess he didnt look and just pulled out when we did... well here are the pics

i just reread your post... was there an officer dispatched to check it out and at least determine who was at fault?
