Got in a wreck last nite.....emergency room and the whole deal

ok, last nite at about 5 oclock, i was riding in my buddie's 'teg. ya, i know, but its FWD and it had been snowing and icing and he was gonna be my DD, cuz i don't drink and drive. well, we're on our way to this party, and some guy slides thru the intersection in this 1988 olds cutlass delta 88. hit the passenger side (me.) rushed to the emergency room, broken elbow and shoulder is lookin pretty gross too, possible chipped rotator cuff. twisted ankle and bruises all freakin over man. today i feel like he11. missed work today. cant sleep cuz i may have a bruised rib. this is not the worst of it. not nearly the worst of it. the doc said my shoulder may have 'problems' healing properly, if so, i'll never drive a stick again. my heart sank for like 3 seconds, then i realized, all the more reason to buy a RHD!!! i told him that i'd just buy a RHD and he said, 'is that legal' and i said, 'sure, if you go thru all the licensing and legal junk'. so, i may be getting a hefty settlement out of this, and if so, watch out for a GT-R badged R32 running around southern Indiana. oh yea, and the reason why i may be getting more than the average amount of money is cuz the driver had a .02 BAC. and i was going out last night too. oh well, just thought u guys might wanna know, this is general chat, right? P.S- the 240 is still for sale ;-)

I hope your shoulder heals. That way you dont have to sell your 240, and you have a Skyline + a 240.

hope the idiot got it alot worse than you did. take 'em to court, make him pay for his two mistakes, 1) driving drunk and 2) driving an oldsmobile.

Tell them you can never drive a stick again and since you're a professional car racer your career is over and you'll need atleast $100,000 to make up for lost work time + personal damages.

ya no sheet. i mean, i have to go thru all this rehab and B.S. plus, today, the day after, i only get to be home for an hour befor ei have to go back. well, now actually i gotta leave. wish me luck. i blacked out last night, so i didnt see the guy driving, just his headlights. as for being a pro car racer, i was a Kart driver and Quad driver when i was younger, i guess i could tell em i was taking some 'professional time off' to work up a new skill no one has mastered or something and make em give me a f00k ton of moolah. i'm slightly bitter, yes? yes.

on a side note, looking at the motorex site, I would never buy a car from them.

If they can't complete a ****ing sentence without screwing it up, why would I want a car from them :(

.02 is legal. Do you mean .2? I dont think you should get the settlement your asking for. The money isnt for buying fancy sports cars. If thats the first thing that your thinking then it just confirms the sad state of the legal system in america. Lets not abuse it. A settlement is great, but I dont think a huge one is appropriate, but who am I.

Glad to hear your OK though. I hope everything heals up nicely!

wow that's horrible I'm sorry to hear that happend, yea reem that guy for everything he's got and then some. I'd recommend going and getting an R32 GT-R from RBmotoring from sean morris, you could prolly pick one up for about 34 Gz and not have to deal with motorex and they're ultra expensive prices and long waits.

I agree with you; but not in this case. This idiot knew what he was doing, you don't accidently get in a car drunk and run through an intersection and t-bone a car.

Let's face it, if you're stupid enough to get into a vehicle drunk, or have had enough to drink that you cause an accident you deserve to get reemed.

People are sue happy these days, if someone wasnt paying attention & accidently ran the light or something. That's "ok" so to speak, granted they need to pay more attention.. but sueing for that would be pretty stupid.

If some ****wad liquors himself up 'real good' and then gets in his ****box oldsmobile and runs through a red light & hits you and your friend, nail his ***. The idiot needs to learn from his mistakes.

very true, same goes for coked up morons running from the cops that drive down wrong shoulder of a 4 lane road the wrong way while running from the cops one night and T bone your mom giving her a major concussion and not allowing her brain to function the same ever again.

Sorry to hear about the wreck. Make sure that you sue that drunk ***-hole for everything you can get, and then some more. That's brutal about the shoulder. Stay away from the computer while you're healing. Pounding away on a keyboard for a couple hours a day will definitely keep it from healing properly.

thanks for all the kind words fellas. i've been so dang tired lately all i end up doing everyday is sittin around watching movies with my arm now in one huge janky cast. my bro is doing the typing right now, as for the BAC it was.2, not .02 like i had previously stated. i've been away from the comp for a while cuz of the laid up arm. but im gonna definitely be lookin into skylines maybe a RHD WRX STi or something crazy and fun. cant wait till this cast stops itching!!!! just generally bein bored around here, doing tons of paperwork here and sleeping cuz of the pain medecine. yay for whatever they gave me!!! lolz. well, back to take another nap. peace out and godspeed.

Sorry to hear of your accident and the injuries. But always looking at the bright side at least you live to tell your story. =)

Now to ground you a little bit, settlements are not necessarily based on how drunk a person is. It should be based on your actual damages incurred. Settlements are not a punishement against a driver, but rather indemnification of your loss. Or to put it simply, to put you back in the same position your were(mostly financially) before the accident. So whether the person was drunk or sober, should have no bearing. A jury may put some weight on it if it goes to trial and the argument could be made, but I would expect a fight from the insurance company on that fact. You won't need to argue this too much anyways. Provided the person has decent limits, with a chipped shoulder and broken elbow, it's a pretty substantial injury.

Secondly, as far as the comment about losing future earnings, say as a professional race car driver, you better be able to show that you were actually making money doing that. I doubt any insurance company will pay based on speculation, and the chances of a jury finding for you on that would be slim in my opinion.

This is not necessarily directed towards you DTH. Just trying to keep everyone realistic and grounded here.
