Got a question on a ticket...

Okay, my dad got a ticket yesterday. I think the charge is totally crap. It was a two lane road, one lane going in each direction. There was a car in front of him going slow so he decides to pass. It was a broken line so he passes on the left. He gets stopped and the officer said he could only pass on the right. Am I right to think that the cop is on crack or am i wrong?

yea thats what I was thinking. Im sure his story is right, so its not just me to think that the cop was just an idiot right?

Depends on the lane markings and the way the road is set-up. There are provisions in the CA Vehicle code that dictate when it's legal to pass n the right.

Here are a few of codes you might want to look at:

Passing on Left - 21650, 21750, 21752Passing on Right - 21754-21755

Best thing to do, take the vehicle code the officer cited him for. Read it. See if it applies to the road and location where your dad passed. If not, I'd say fight it.
