Four tickets in one sitting! read inside, i wanna fight them!

ok so it goes like this. My 240 recently sprung a leak in the PS system, and i needed to get it fixed. A lil background info:

1. no emissions sticker due to SR swap and lack of hook-up in that department2. no safety inspection due to lack of hook-up in that department, and personal lazyness3. registration was expired...did not know that! it was 1 day past or so...

so, here goes the story...i bring my car into auto tech and fix the leak w/ some fuel line and clamps...all is good, no more leak, gotta get the air burped out of the system. So i'm on my way home, and i pick up my girlfriend form school for lunch. We're gonna go eat at home, and leave w/ my mini (daily driver for now). at the stop sign by the parkinglot, literally 1 block from school, I watch a undercover cop pull a U turn and come to pull me over, as i'm putting on my seatbelt.

He says, "do you know why i pulled you over?"

I say, "actually, no i'm not sure"

he says, "just give me your liscense and registration :rolleyes"

blah blah, usual cop banter...finally

"i pulled you over because i saw you weren't wearing your seatbelt, if you hadnt started to put it on when i looked at you, i wouldnt have even noticed"...

!!!???!?!WTF? i didnt even put it on cuz i saw him look at me, i just remembered when i stopped...i had backed out of a space, then proceeded to drive uphill to the first stop sign at the exit of the lot...cant put ur seatbelt on at that angle...then i got to the next stop, which was where i was pulled over...NO FAIR!

but then he proceeds to write me all these other tickets...total=4

*expired registration*no emissions sticker*no va safety inspection*no seatbelt

POINT OF THE THREAD!!!! for all the impatient people

Can he pull me over for no seatbelt, if there is literally no other reason to pull me over?

in the state of VA, i know seatbelt on the driver is a law...but is it a primary offense...in otherwords, if i go to court to fight it, can i get it dropped on the premises that he unlawfully pulled me over to begin with?

well obviously i'm not gonna fight it if it is rightful for him to give me those citations...but if it's not...i'd like to have them dropped

Sounds like a large pickle you are in. I don't know how to help, sorry. Good luck though, haha.

heh, so i just looked them over agian...he wasnt a total douche about it...2 were warnings, the seatbelt thing and i was wrong about the other one...it was actually for improper liscense plate display...soo it goes this way

2 citations:1. no va inspection2. expired va registration

2 warnings:1. improper display liscense plates2. seat belt violation

so technically i only have to worry about the 2 citations...does this mean i have to appear in court w/ the re-registration and an inspection sticker? cuz if so, that's easy...

Depends on state laws, but sounds to me like you'll be off with a fine. Find out if those 2 are moving violations or not.

not moving violations...obviously since i was stopped when he decided to pull me over...i asked also, he said not moving violations...so i guess im' off the hook?

You'd do yourself a HUGE favor by having either registration or a temp tag, by the time you go to court.

The emissions is a whole 'nother deal. Have you tried to get an emissions inspection and failed? Or just not tried?

just not tried, i know it's my fault...and i can get it re-registered any time i want...it's not like theres anything stopping me, i just didnt notice! how stupid of me :( but i think i need the emissions done to get re-registered...but i have a hook up now *i think*, i just need it to get done...

I do not know about your state, but in California, the CHP and local police will often make the inspection and missing registration a "correctable" citation that is a small fine rather than a major amount and you do not need to go to court. YMMV applies!

Then, if you get the inspection done, go to the DMV and get the registration, it does not show on your driving record, etc.

This happened to my wife's car once - I paid the registration via mail but did not get the license plate sticker and forgot about it! Needless to say, I got pulled over and the officer was reasonable about it.

just get the damn thing inspected and registered. find the cop that wrote the ticket and tell him you are sorry and its registered and inspected now, he may drop the charges. If he doesn't show up to court early and show them that you did it and ask to drop. they may, may not. if they still dont ask that the tickets be dismissed if you just pay the fine in cash. they will usually do that, and that way you get no points or anything.

Since they are non-moving violations, I doubt you will get points anyways. But since you have an SR, I suggest you find a hookup real quick.

All I have to say is that it sucks to be you right now Ian, I'm sorry man.

Sorry to hear. At leat a couple were just warnings. And yes, at least here in Indiana, they can pull you over for not wearing your seat belt. They actually set-up random checkpoints to make sure that people are wearing their seat belts.

Good luck with the emissions problem.

youre in arlington va right? well theres a place down here near richmond where guys take their coughsmoggycough cars where they dont even check for that type of thing. or do you have to get an inspection in the county that you live?

it might actually pass the sniffer legally...my CA almost did. It only failed by 7ppm for excess unburnt hybrocarbons (running rich). If I had some sort of fuel control system (afc, emanage, etc etc), it would pass. I dunno about the visual check, though.

I'm not sure about VA laws, but in GA, you can definitely be pulled over for not wearing a seatbelt.

well i found out everything he did was in line. so sucks for me, but i gotta get legal in a month and re-registered, so i can show up to court on the 21st of May and get the charges dropped. anyone in NOVA or SOMD? lol the DC, VA, MD area have a hookup for emissions? my guy is kinda ****ing me around n i need this soon!
