so today im heading home from work.making sure not to go too fast, just cruising.next thing you know a cop decides to get out of his hiding spot, get behind me for about a minute, then turn on his nice BLUE lights.obviously im like S***!!! i pull over to the turn lane on my right, the Jerk comes up and says "is there a reason you were going 68 in a 50." im like "what???, i was making sure that i was not going over 60" he says "well i got you doing 68, let me see your license"im telling him, "sir, it must be a mistake i made sure no to go over" (i know for a fact i did not do 68!!! WTF???????

so this :moon takes my license, says ill brb. so i think he'll jus take a quick check and come back with a warning, but noooooooo he comes back with a ticket and says court is in january.im like sir could you please just make it a warning (at this point no need to fight that i was not doing 68). he says no, gives me a blank stare and waits for me to sign his stupid ticket.

this is just great, if my parents are to find out about this, i wont have a car to drive with!!!!!

im thinking about going to court, pleading "not guilty" and fight it to the point where it does nothing to my record maybe just a fine.

what do you guys think?

sorry, i had to vent!

you should have asked him for proof on the radar of 68.

if he doesnt have proof i assume you can fight it

ah well, next time just drive like I do, 5mph bellow the speed limit. it's more fun , you get to enjoy the car, the scenery, the nice sound of the vq, some nice music, lol

I dont know how it works in the U.S but I would go to court so you dont get any points on your license and I believe if the cop doesnt show up you should be let go "free of charge" Ive also heard that you can ask to see when his radar was last calibrated, if it doesnt have a calibration record (up to date etc.) I think you would be off the hook.....good luck tho!

Yup yup. Up here, you're guaranteed either the removal of any points or a halving of the fine...or even both! Take that sucker to court ASAP! I won't get into the details here, but if you're persistent enough and actually take the stand and make a statement there's a very good chance you can get out of the entire thing. Do a google search for "proof beyond reasonable doubt"...

I got pulled over for my exhaust on the interstate. GReddy. There was a whole lot of traffic and i wasn't even speeding. Sometimes cops can be d*cks. btw that was my first ticket ever...

You might be able to speak to the prosecutor in the court room and explain that your record is clean and whatnot. Often times they will make you pay the court costs, but the ticket will be dismissed and will not go on your record. That's how things work in MN, anyways.

you really should of asked to see his radar gun. but yea defenetly take him to court. The cops in GA are sneeky lil basturds and they rarely give warnings. Unless you are military and away from Benning. lol

i'd definitely take the chance in court, but don't pay for a lawyer for such a small fine. In most states ifthe cop doesn;t show the ticket goes away, no fine, no points, just court admin fees.

Sorry to hear this bro but as a citizen you have certain rights. But if you are certain that you were not speeding then, make them work to get your money. It's gonna take work on your part but if you do your research right, you'll win the case. It's called burden of proof!

You are also entitled to know all the facts about the case and supposed 'evidence' against you - BEFORE THE TRIAL. Toward that end, you are permitted to request a Bill of Particulars (documents and questions about evidence) from your accuser to help you fight the alleged criminal actions charged against you. See Rules of Criminal Procedure 572.

Basically, you will send them document of Interrogatories and Request for Documents. They are required by law to provide you with the requested information so you may properly prepare your defense. Interrogatories are questions just in case you didn't know

First you'll need to know what code you broke. That would be listed on the ticket. Then do a search for that code on the internet and see what that says. If you have a friend who is an LEO, I'd ask him to see if they can get you a copy of that vehicle code.

Next, prepare your questions or interrogatories. remember that this needs to be laid out in a certain format and certified mail to the Police Dept, DA and the County Clerk.

This seems to be a lot of work but like I said, if you think you weren't speeding, you are entitled to defend yourself in court properly and make them work for it.

lanya/esp- do i make a call before the court date to have them bring that document, or do i ask for it at court? (calibration date)

wow I never heard of having to "sign a ticket".... Nothing like that here.

What happens if you refuse to sign it..? Do they take your signature as Proof of your admitting that you are guilty???!

Definitely go to the court date, they should take it easy on you,.

singing the ticket just means that i received the citation, not admitting to guilt.i believe if u dont sign, then they tow your car and you spend a night in "jail"...correct me if im wrong.

The DA should make you an offer being a new driver etc of no pts and just a fine.... DONT SCREW UP YOUR LICENSE MAN!

im sorry bro...next time see it as an opportunity to see if the cvt can take on a cruiser...when u do get caught ...tell him you thought he wanted to race....and being thats hes behind you....HE lost YOU owned him and he should let you go or fork over the pink slip...

on a serious note....dangeris is spot on...there are many things that effect radar....other cars....guard rails....trucks...etc....even planes!....there s strip of highway near me...with a major airport just off the road...planes landing 50 ft from road side....lolumm excuse me son...but i clocked you 300 in a 50...lic and reg please...

hahaha. If a officer said I was doing 300 in a 50, i would asked him to bend over so I could smell his breathe. Then ask him to place his hands on the hood while I arrest him for oviously being on some really good $hit while on duty.

Miss Lanaya is right. You should ask when the last time the radar was calibrated and when he was last certified to use the equipment. Ask them for documentation stating that.

Also ask were they're other cars in the area that would have reflected their speed as yours.

Witness, was there anyone else that were or was involved that can give credit to his citation.

Just a couple of questions that come into mind.

you may want to re think this i remember when i was young and got a speeding ticket. some time it is just better to go into court with your head down and not anger the judge and wast his/her time. the judges don't like young drivers i would just try to get supervision or traffic school. and i learned my lesson from that day to always drive with a radar detector. the way i see it is if it saves you from 2 tickets then it has already paid for it's self, when you pay a ticket you pay and get nothing in return (except you get angry when you see cops )
