The easiest way (without prohibitive legislation) to outlaw something has always been to make using it more difficult, "allowing" people to make their own decisions.
This can even be seen in the first century with state leaders charging a head tax to those wishing to practice their own religions (for instance, followers of Muhammad in 7th century Saudi Arabia). It wasn't always outlawed to practice freely - but it became quite a financial hardship to practice as one pleased.
It is no different than what they are doing now. It's a way to punish and regulate without tax, and Tech is exactly right - if we do nothing about it, then it is 90% our fault for not speaking out.
Legislation is not the only way to govern, and there are very sneaky and powerful ways to exert power over people without prohibition or taxation.
As disorganized as most think government is, there are more agendas within those buildings than every university in the United States combined.
