Drivers Seatback Seat Back clicking and moving problem

I am having a problem with my driver's side seatback on my 2009 Versa Hatchback SL. It is only with the drivers Side Seat: The drivers side seat back is clicking whenever I hit the gas or break or when I lean back or forward. It seems to move a half centimeter each time, and never fully locks into place. Seems like the seatback is loose where the back connects to the seat base.

I have taken the car to one dealer in Raleigh, NC and they said - yes the seatback clicks, they took it apart, re-installed it, and said they could not fix it and that it is normal for all Nissan Versas. I said "No way is that normal, it does not seem safe either, and it cannot be normal because the passenger seat does not do it." I opened a claim with Nissan Consumer Affairs and the South East rep directed me to take it another local dealer to evaluate. Which I did, the dealer acknowledged the issue, but said they did not know how or what would fix it. I said wouldn't replacing the seat fix it? I was directed back to my Nissan Consumer Affairs SE Rep, who said she needs to contact Nissan engineering to see if there is a solution, before they decide to replace the seat. I am waiting to hear back from her now.

I believe this has been discussed in the forums already. What bothers me is the excuse you get with this car every time there is an issue. " it is a cheap car and you should expect quirks like this in one"

My seat was clicking and took it to Sheehy Nissan in Manassas and they replaced the seat back and no noise since and that was 1 1/2 years ago.

I really wish all dealers followed the same rules or conduct....they are all over the place with warranty work.

This is odd because about 2 or 3 days after I got my Versa I noticed a groan/movement type sound from the drivers seat too. It seems to be locked into place, I moved it around, adjusted the headrest too. When ever I lean into the seat I hear it groan and it sounds like something is moving against something but I don't feel any movement from the seat. I haven't taken it to the dealer yet. I wonder if I have the same issue? I've an 09 Versa S it's about 3 - 4 weeks old.
