Drivers seat cracking

New member, 1st post. Just bought '07 G35X sedan 38K miles and noticed the side of the driver's seat where you get in is cracked in several spots, along with the foam side bolster being broken down some. 2 local MD dealers said not covered under warranty. A leather repair guy thought it should be. He said only the top surface of the seats is leather and this side area is vinyl. Anybody had or heard of this being a common problem? Thanks.

I have an 07 coupe and had this problem a few months ago...the replaced mine under warranty fo unusual wear... is there another dealer nearby that you can try??
