TL;DW

1. Would be teeny robbers attempt to rob store at gun point.
2. Teeny robber gets (fataly?) shot in the head.
3. Teeny robber (considered to still be a treat) gets another 5 shots to the chest.
4. Store Owner (shooter) is found guilty of 1st Degree Murder. Sentence to life in jail.

America WTF is wrong with us? :facepalm:

That article doesn't have the real details of that story.

Robbers try to rob store.
Owner shoots Robber #1 in the head.
Robber #2 takes off running.
Owner chases, fails to catch, and returns to the store where 1 is still lying on the floor from headshot.
Owner puts 5 rounds into #1.

Now I'm all for him shooting the robber in the face, but the 5 to the stomach was 1. Unnecessary, and 2. After he had been subdued.

I have to agree with the jury on this.

I agree is the whole "took it too far" deal. But 1st degree murder?Really?

Why were they robbing the store? Was it for fun or did they have to feed their family?

Murder 1? I'm no attorney, but seems to me that the circumstances don't meet the criteria to merit that charge.

Isn't first degree murder where you intentionally kill someone with out need?

Isn't self defense where you do only what is necessary to defend yourself?

Yes, the person killed was a criminal and a thief.
If he was caught by police, and was being brought out to the squad car when the shop owner ran out and shot him dead instead of letting him be tried would you still defend the store owner?

How is it self defense when the shop owner is chasing the threat? How is the shop owner shooting and killing a subdued man any different from him deciding to murder the thief later on?

Well murder in general is about intentionally killing someone without need.
Murder in the first degree in most cases means it was planned.

If the guy would of hired them to act like they were robbing the store, killed them, not called the cops, and dumped them in a already thought of cement barrels and then later dumped in the middle of the ocean.

Then yea it would not confuse me why 1st degree was brought up...

Ok store owner... Property and Business Location owner? I think not. Meaning, did he own the business and the building? If so, this wouldn't be at trial. It was NOT private property, it was public.

Civilian shooting another civilian in a public area near or towards a public street WITH pedestrians? Correct.

Completely, illegal.

One shot, is enough. If he got away or not. One shot. Not 6.

I defend this mans rights, but I do not defend this mans actions. Where is IBcoupe, he knows all about the judicial system. We need sources!

Sorry, I think I watched to much Night Court/Law & Order.

Planned as in heading back to guy you shot after trying to chase down his friend, then shooting him 5 times in the chest?

The first shot was unplanned. A situation happened, and he dealt with it.

The next five he decided to go back and do... Sure he did not plan it months ahead of time, but the plan was to go back and make sure the first guy was dead. The minute he decided to head back and finish off the first guy he planned to kill him.

I see it as heat of the moment thing.

The kid just finished pointing a gun straight at you. Tell me that wouldn't of made you mad. What are gonna do after you shot him? Try to give him medical assistance?

In that case, case should of been a 3rd degree murder charge and that the most extreme 2nd.

Common sense would of just let the guy go. Now a days his safest bet you of been to take a knife, open the kid up, make suit out of him, and run around screaming "I'm manbearpig manbearpig!" So he could of gotten of with an insanity plea.
