Cruise Control Issues

Hello there. I tried to search to see if this topic has already been posted, but I could not find it anywhere.
Ok so the issue is that when I go to set my cruise control, it wont set. Both lights come on as if it is already engaged, however it beeps at me when I turn it on. The dealer told me that it is possible that it wont work because my battery is going bad. Any input?

What do you mean both lights? One cruise light should come on, and the LCD in the tachometer should (for ICC) show a -- indicating no speed set and a radar icon indicating the configured following distance. Standard cruise won't say anything in the LCD until you set it and will then say "Cruise Set". If there are two cruise lights in the tachometer, one of them is amber/orange/red and indicates a problem with your cruise control (I know this because I posted a similar question once, being colorblind and not realizing the second one wasn't the "set" for the standard cruise). You can go to the previously referenced troubleshooting page, but this sounds like a problem for a dealer/tech. The only thing I can add is if you have ICC and the LCD says "clean sensor" in ICC mode, standard cruise won't work until the computer is "rebooted", so you would need to shut the car off (an ignition cycle isn't necessarily required, but in my experience, restarting the computers and not the ignition leads the transmission to limp mode more often than not), and after starting up again, you would need to hold the cruise button the first time in order to skip ICC mode and not get the dirty sensor detected.

Note that if you don't have ICC, it is possible that none of this is applicable, as I don't remember (from reading the manual for my 2006 M45 in 2009) whether or not the vehicles with standard cruise only have the LCD panel and /or what they have instead that you could be referring to, and even if I did, I wouldn't know what the behavior meant.

Keep in mind that it does not work at all in Manual mode. Mine beeps at me when I move to manual mode and the cruise is on.

Maybe the 04 doesn't work at all in manual mode, but the 06 works fine in manual mode. I even tested this morning before replying. My 06 (manufactured April 05) will not disengage cruise and beep at me for any of the following:
switching to manual from automatic while ICC is engaged
switching to manual from automatic while standard cruise is engaged
switching from automatic to manual while ICC is engaged
switching from automatic to manual while standard cruise is engaged
shifting up or down (between 4th and 5th) while ICC is engaged
shifting up or down (between 4th and 5th) while standard cruise is engaged

In fact, the only scenarios where I know it will beep and disengage cruise while are the following:
direct sunlight overloads the ICC sensor while ICC is engaged
wipers run without a delay for more than a set amount of time while either cruise is engaged
switching to neutral while either cruise is engaged
traction is lost while either cruise is engaged (IIRC, this may not cause a beep)
