Coupe Remote trunk opener: design flaw or bug?

Had my coupe for a month, and yesterday tried opening the trunk with car in gear, and was shocked that it DID OPEN. Every other car I've had would only open trunk in Park, yet in both reverse and drive, the trunk release button on the dash opened the trunk.

I'm assuming this isn't a defect in my car, that it was designed this way.

Does anyone have a trunk that WON'T open in gear?
