Chime in on my speeding ticket dilema

General discussion forum about the 240sx, and a great place to introduce yourself to the board!

I got a speeding ticket for 63mph in a 35mph zone where the cop wrote violation of vehicle code 22349 then crosssed it out and wrote 22350 instead. He assured me that it was a lesser charge and that I would be able to go to traffic school. I contacted the court and they said that the violation was not eligible for traffic school and the fine is $350! Do you guys think the court wrote down the initial charge not seeing that it was crossed out or that the cop screwed up. Considering he popped my hood I know I lucked out and I'll pay the fine either way but I wanted to know what you guys think.

22349 - Exceding speed limit ( 65mph )

22350 - Unsafe speed

That's what I've been written up for according to the tickets.

Not sure excatly how the law works in Cali, but here in Ga if you are caught goin over the limit by 24 or more, you loose your license. $350 sounds alot better than that

Fergus I just have to add that in ga that law is if you are under 21 or some age like that. It doesn't apply to older people.

cant comment on cali traffic court, but i just got slammed with a ticket recently in nj. it was 46 in 25 speed trap. gave me careless driving 2pts instead of 4. prosecutor amended it down to 0pts unsafe driving. i thought i was doing good $150 fine + $30 court fee WHAM! +$250 surcharge =$430 .

seems like theyre always figuring new ways to stick it in your ***.

quick secret for getting out of tickets. Ask for a Trial by Declaration...you have to pay the fine initally but there is a very good chance of being found not guilty....Let me know if you want more info on this

i got out of 85 in a 45 with just a $200 fine

6 points for 11 years though... (in VA)

its not something they adertivse cause its a pain in the *** for the court system. Basically you have to request it.

1. You pay the fine and they mail you the paper work.

2. you write a letter (under oath) of what happened.

3. Officer who issued ticket is given the same amount of time to do the same thing.

4. when the judge has both letters he/she reads and makes her ruling.

5. if the officer does not send in their letter the case is thrown out.

usually the officer doesnt bother to write in because they dont get paid overtime to do so...plus its hard to remember what happened on a specific ticket.

now here is the kicker...if the judge rules against you..you can contest the ruling and ask for an in person trial, because you were not able to cross examine the officer...

if the cop shows up to the trial date you are pretty much screwed cuz he has something major against you.

I have sucessfully used this in the past and will do so in the future

oh yeah if you are found not guilty...they mail you the fine amount back.

Friend's mom recently got a ticket, the school bus was stopped with flashing lights on the OPPOSING side of traffic. She didn't know to stop and ticketed. Anyway, today my friend found out the price of the ticket... FIVE HUNDRED AND FIFTEEN DOLLARS... $515 !!!!

no way out of that one...flashing lights by a bus means both directions of traffic must stop

Just go talk to someone at the court house But i have all you beat 140+ in a 65 zone got off with a 9 over ticket i still have the ticket if you guys wish to see it

What is it that you contest under oath in the letter?That you werent speeding? or the Cop was hiding? or he pulled you over for no reason? Just wondering how you would explain that, so I can use it in the future:)

basically what you are giving is your explanation as to what happened.....deny lie bend the facts, however you write it is up to you

110 in a 65 and the ticket disappeared before it made it to the courthouse

wish I would a tried to do moer about the $389 ticket I got few years back for goin 18 over. Ticket price was set up i brackets. If I had been going 23 over it would of been the same. another reason I hate rural towns that rely on speed traps to fund their police cost. I might of not been so upset if the state patrol officer hadnt been hidden so far into the woods that it took him 2 mins just to get out on the road before he could catch up!

i can understand 5-10 miles over..... but almost twice the speed limit? he should have got you for wreckless driving and towed your car away. Thats friken insane.

You guys have points!? Then it's like a game ;] I assume it's like golf, the lower the better. Yeah, I just got a ticket doing 57 in a 45, but I was eligible to mail the ticket and get supervision + traffic school to keep it off my record.

Depending on the situation it may or may not be fair. If she was driving in another state other than her own, the regulations are different when it comes to school buses stopping and letting off kids. Here in Delaware, if the school bus comes to a stop to let off kids on a road that has 4 lanes or more, the traffic on the opposing side does not have to stop--regardless if there is a median or just a double yellow line dividing the road. But if you go into another state it may be different.

Unless of course the kid's mom was on a two lane road (as in one lane on each side) then she should've stopped regardless of what the stipulations are.
