Check Engine Light 2009 Murano

I have a 2009 LE Murano that has a check \engine Light coming on, first time they reset, code was p0710. Two weeks later code came back . Dealership said same code and only choice was to replace transmission as sensorl was sealed. Two days later received a call and said Nissan turned down transmission replacement and advised they were going to reprogram as sensor was detecting heat issue erroneously. Still waiting for software fix, been three weeks. My concern to dealership that if it wass software issue why haven't they had others with same issue. Aside from that no problems, car 5 months old 8000 K on it. Any other heat issue experiences out there
