Car totaled ... not my fault - what do I do?

Okay, I haven't spoken to the other person's claims adjuster, but I'm almost preparing for rapage. The car a 92 Nissan 240 Hicas Nada's value is apparently $3300 stock. But my car isn't stock, I calculated the value of the other things in it at approx $3315. So I would like a check for 6615, but I know this won't happen. I don't have receipts for very much of the stuff if any, how can I recoupe my losses, I would actually like to get an S14 now, but if I get raped on the claim check I don't know what to do. BTW it is her fault and she admitted fault to the cops and she will to her insurance company. She ran a red light. I also have some soreness in my neck because of this, but I walked away fine and so did she. This happened yesterday at 4:00 PM. Just wondering what the consensus is regarding me getting back my investments w/out receipts w/ negotiating the the insurance company (Farmers). This is for those of you who know and those of you have went thru it. Any help would be greatly appreciated. Thanks.

Depends on your insurance company, but most of the time. MODDING your car, you don;t get it back. SUcks.

I believe it depends on your policy. But I don't think it looks promising to recoup mods unless you had them already established in your policy. Very few people actually include mods on their policies as it would raise premiums. It wouldn't hurt asking your agent, but I wouldn't bank on getting it. Good luck

You might consider small claims court - name both the other party and their insurnace as defendents. Sometimes, the insurance company is willing to settle for more to avoid having to deal with the hassle. This is not a guaranteed situation.

Also, if you have neck soreness, then get it checked out. This may turn out to be more than you think and could get you some extra funds from her insurance company.

Not having the receipts is going to hurt your ability to argue for a higher price. There has to be some way to get receipts unless you're a DIYer. If not, go to the shop that did your mods.

If your mods are still usable, just get another 240 and slap your mods on that one

Do not give a statment to the other insurance company. Don't sign anything. Get you insurance company and attorney involved. I was hit while driving my maxima, looks like it will be hard to get the insurance company to pay for the rest of the bill. Here is the thread http://www.nissaninfiniticlub....58014 . If it comes to this, you could always get the vehicle totalled out and then try to buy it back on a salvage title. You can then either use or sell the aftermarket parts on the vehicle and scrap the rest.

Good stuff, I've already made a statement to MY insurance company. Hope that doesn't negatively affect me, however all I was saying was how it was her fault and she ran the red light. Haven't even spoken to farmer's claims adjuster yet, but I will not make a statement to them. I'll be calling a lawyer tomorrow. Thanks for the help guys.

the person who hit me had farmers insurance too. Its now 3 weeks later still no check. Farmer's will call you after you have filled a claim with them. I had to call their 1-800 number. I gave a statement on the phone. The insurance guy on the other end said he was typing it up, turns out they also recorded my call. When asked about my car I said I have no idea how bad the damage was. They are trying to push a 1200 check on almost 2000 in damage. The local person already came out to take an estimate. So far I haven't signed anything. Nick
