Check and see if you're insurance covers you if you're hit by an uninsured driver, I know some policies have this coverage.
also, there's this magic thing that americans are in love with... it's called suing. If he's at fault, you'll win, especially since proof of financial responsibility is something that all drivers must have (typically it's insurance). If you choose to sue, get a copy of the officer's report (assuming there was a cop there) that states the other driver was clearly at fault to present as evidence and you're golden. If you didn't have a cop there to check it all out, well then you're s*** outta luck on this option.
