Brake pedal warranty problem

My brake pedal itself makes a slight airy/squeaking sound when pressed, kind of like one of those squeeze toys. It's not the brake system as far as I can tell. No problems In braking. Dealer says brake assembly needs to be replaced. The problem is, he said because I drilled aftermarket pedal pads into the brake pads the warranty won't cover it. I said the sound has nothing to do with that, and he acknowledged and agreed, but he said once infiniti gets the brake assembly back and sees four holes drilled in the brake portion, they are going to reject it.
What do you say?

You mean you have one of those fancy sport pedal covers and had to drill 4 small holes to mount it to the brake pedal and they won't honor your warranty because of that?! So take the cover off and go to another dealer then tell that dealer the rubber fell off. Bunch of nit-pickers!

Sounds like a good idea, but it's already in the records that I came for that. Im about to go on a campaign with FTC, bbb, department of consumer affairs, maybe file a civil suit (depend on cost), talking to my cc company to issue a charge back for the warranty, and a few other options. This is principle now.

Magnusson Moss Act...they have to prove that your modification is the reason for the problem...which in this case impossible.

Yeah, I told that to their customer care division, and they said there is nothing they can do, although I was driving so I couldn't really get into it. I'm going to call them back tomorrow and get into it and let them know my plans and let them decide what they want to do at that point.

Don't forget you can also file a case with BBB. They tend to investigate and if there are enough open cases help class action suits.
