6 State Attorneys General Warn Biden Over Potential Presidential Overreach

A coalition of state attorneys general on Wednesday sent a letter to President Joe Biden reminding him that any potentially unconstitutional executive actions or federal overreach will not go unchallenged.

The letter, signed by six attorneys general (AGs), puts the Biden administration on notice that any actions that might exceed their statutory authority, are inconsistent with constitutional tenets, or place civil liberties at risk could trigger legal action by the states.

“We stand ready to meet with your administration to discuss more how the issues below affect our States; litigation is never first option, and we would like to help your team in its important job on behalf of all Americans, consistent with the Constitution and the rule of law,” West Virginia AG Patrick Morrisey, who is leading the group, wrote in the letter addressed to the White House (pdf).

“Yet if you sign unconstitutional laws passed by Congress, it will be our responsibility and duty to challenge those laws in court. If cabinet officials, executive officers, and agencies go beyond the bounds of their statutory authority, fail to follow legally required procedures, or fall short of the bedrock Administrative Procedure Act obligation of reasoned decision making, it will likewise be our responsibility to take action.”

The Administrative Procedure Act, or APA, is a federal law that governs the process for agency rulemaking and has been frequently invoked to challenge executive branch rules and regulations.

Morrisey is joined by AGs from Arkansas, Indiana, Mississippi, Montana, and Texas.

It comes as Biden issued a series of executive orders in his first week since taking office. Some of the executive orders have overturned Trump-era policies, while others have established or expanded policies relating to climate change, racial equity, and the CCP (Chinese Communist Party) virus pandemic.

Some of the orders have already drawn widespread scrutiny, such as the decisions to rejoin the Paris Climate agreement and to cancel the Keystone XL Pipeline, which is expected to put thousands of jobs at risk and undermine the U.S. relationship with Canada. The Biden admin has also met with backlash for embracing a quasi-Marxist critical race theory in its policies seeking to prioritize certain racial groups that have historically met with disadvantage over others.

Subtracting the 85,549 American deaths (I did not verify your figures and you neglect to provide a source) from the total US death toll as compiled by The John Hopkins Institute of 498,003 results in a 412,454 death toll under the former president Trump.
Trump failed to place a large enough vaccine order.
Trump failed to develop a plan to distribute the vaccine.
Trump failed to develop a plan to get the vaccine into the arms of all Americans.
Trump failed to inform the states on how many doses of the vaccines they could expect to receive in December and January.
Trump delayed giving Biden access to requested information resulting in delays after January 20th 2021
Trump failed to encourage all Americans to wear a mask
Trump promoted large gatherings and rallies that resulted in the spread of Covid 19 resulting in some deaths. (Herman Cain and others)
And last Trump still fails to concede that he lost the election and is still promoting falsely that he won and the election was stolen without any evidence. More than sixty cases were dismissed in numerous courts in many states by republican judges that were appointed under Trump.
Under President Biden I received my first Moderna vaccine shot two weeks ago and I will receive the second vaccine shot next Sunday.

Howie, your facts are in error again. First, of the 80 total lawsuits, 34 have either been withdrawn, consolidated with other suits, or dismissed due to legal technicalities such as lack of standing, timing, or jurisdiction. Those judges who dismissed suits never heard the actual evidence of election irregularities and/or fraud, since they did not allow it to be presented in their courtrooms. Such cases cannot be counted as a loss for Trump. If anything, they are evidence of a failure of our judicial system to – at a moment of national crisis – actually address election fraud.

Of the 46 remaining lawsuits, 25 cases are still ongoing, so that the winner and loser of these cases is yet to be determined, while 21 have been completely adjudicated. These are cases where the court heard arguments, considered any relevant evidence, and then issued a formal ruling on the merits.

You may be surprised to learn that, of these 21 cases, Trump has won 14 and lost 7.

In other words, Trump has won two-thirds of the cases to date that have been adjudicated by the courts.

Don’t expect to hear this on the evening news.

This Texas problem actually goes back to 1999 when GW Bush was governor and the Texas Electric Grid refused federal regulation and separated from both the eastern and western electrical grids. After another deep freeze in 2011 the incompetent ERCOT failed to winterize gas pipelines supplying gas to generators.
The current republican governor Gregg Abbott is another failed politician.

Personally, I have always liked to believe that everyone has the capacity to appreciate that there's more to life than politics, and also the capacity to realize that shouting about it from morning till night simply amounts to urinating in your own mouth.
