x-g/f ran off with my car. Call the local police to report it as stolen, and found out that ...

(1) If you let anyone borrow your car once in the state of florida, even though you didn't give them permission to use the car again, and find or have access to the keys and take the vehicle, it is only a civil matter, and criminal charges can't be pressed

(2) If you change your locks on your home, with someone elses properrt inside the home and they do not have a key, they can use any force (breaking in) to retreive said belongs at no criminal level, again just civil. If you put said proprty on curb, the owner could press criminal charges against you.

Damn the law.

I have trouble understanding the FL law on the car issue. Did she have keys to the car or did she take yours? I can't imagine there would be a law where if you allowed someone to borrow your car once that they now have unlimted use of the vehicle. If this is the case, it is a violation of several other laws, i.e. conversion. The only way this law in my opinion would be valid would be if the person had a set of keys or they lived with the car owner and had always had access to the keys and the cars use.

So, I take it that after you found your girlfriend from the last time you broke it off with her and you tried to press charges for her stealing your car and then she broke into your place after you changed the locks?

The law regarding the changing locks is a very valid law. It is conversion if you change the locks with anothers property inside. It makes sense. You have taken their property and they can not get it back under their free will. Sitting it on the curb is also conversion because you took their property and made free to the public. But, her breaking into the place seems to still be a criminal offense even with her property inside. But there are several loop holes when it comes to things such as this and it is never or I guess I should say rarely ever taken to criminal charges being brought. This is more of a civil matter.

Good luck with whatever is going on.

Yeah! :)Quote » I can't imagine there would be a law where if you allowed someone to borrow your car once that they now have unlimted use of the vehicle. If you rent (sorta like "borrow") a car, make a copy of the key, return the car and then come back later and take it, is this a criminal or civil matter? Would Hertz get more clout with the police and the judiciary?Quote » But, her breaking into the place seems to still be a criminal offense even with her property inside.[/quote] Isn't FL also the state where you can shoot the intruder in your home and not be prosecuted? I seem to remember such a case there some years ago. I am not advocating shooting your ex GF, of course, but it struck me as interesting that the laws in FL seem a bit different from must of the rest of the country.
