The law in California is that tail lights can be tinted as long as they provide clear indication that the driver is breaking. So in the day time, the light coming through has to be visible enough when you brake to give clear indication of whether or not you are braking. So theoretically, a cop can argue with you over how well he can see the brake lights but it's not something you will get pulled over specifically for. Worse case scenario, you get a fix it ticket. No biggie. Most cops won't bother you over things like that unless you piss them off. Also, just so you know, headlight tinting is an absolute NO. Cops WILL stop you for tinted headlights.
