i personally am happy with the decision. Half of those at guantanamo were turned in by rival factions/tribes with no actual evidence. its nice to know that the constitution is alive and well, even in the face of laws like the patriot act and the wiretapping scandals. it just saddens me that the court was decided basically along party lines.

Holding anyone in prison without the right to counsel and denying them the right to Habeas Corpus is fundamentally unfair, and represents the worst America has to offer. Unfortunately, there are too many detainees who now have a legitimate reason to hate America. Here I have to sympathize with the alleged "terrorlst" as they were wronged.

We fought a war over unlawful detention and speedy trials. Yet we, the government, impose those archaic standards on others. Unconscionably to say the least.

i definatly agree. i just wish Scalia wasnt so nutso. Also, its interesting to see how the vote fell. Oh alito, why so ridiculous.

I think hes beyond nutso I don't thin khe really has a clue..his decisions aren't based on any reading of th econstitution they are based on personal opinion.

To actually make statement at the supreme court level that 'we are at war'. Whatever you want to call our current military engagements, the constitution is pretty clear on this one. Back during the Korean war, a similar claim was made by the solicitor general during oral arguements (Youngstown v. Sawyer) and he got frankly reamed for it. How can a supreme court jurist make such an absurd statement and be taken seriously. That should be impeachable...

I didn't hear any comment fro mScalia during the DC Gun opinion on how this decision will without a doubt get more Americans killed.
