Does this happen to anyone else? Third time in four months I've hit a bad pothole with the driver's front. I never hit a thing with the passenger side. Can I sue the city of New Haven or the state for improper road maintenance if there is damage?

I've had some success with this, there seems to be a difference in the outcome if the hole has already been reported to the DMV, DOT, FTW, BFD, ad nauseum.

A friend drove through a (repair in progress) exposed RR crossing that almost destroyed his car. Once they acknowledged liability, they were ok to work with.

I hit a hole here in Phoenix, a poorly-completed recent "repair".

The check came less than 2 weeks after I filed the claiim. The hole was fixed the day AFTER I filed it, so mission accomplished.

You can claim or sue for anything you want. Whether you actually get paid is case dependent. But I have heard that government agencies pay only a percentage of these types of claims. Not a percentage of an indivisual claim, but they will deny a certain number of claims and pay a certain number. I can't confirm this, but this is what I heard being in the insurance industry. And in California there is a time limit in which you can report the claim. Ratehr convenient that the statute of limitations for the state is so much smaller than for everyone else...
