Accident/abruptly cut off by motorcycle

Quick rundown...

So I pull out of my neighborhood from Superstition onto Chandler Blvd, making a right hand turn onto chandler. Chandler Blvd is 3 lanes each way at this point. I accelerate to 45 and remain in the right hand lane. Just as I get to the texaco station on the right, a motorcyclist with a passenger makes an abrupt turn from the far left lane (right next to the median) and cuts directly in front of me across 2 lanes to turn into the gas station. I swirved and hit the brakes but clipped his rear end.

He got cited for an illegal turn, and I got cited for "speed greater than R/P to avoid collision". The speed on my citation is 45mph and the speed limit is 45. My 50ish yr old neighbor was with me and confirmed all of the events with the police.

The motorcyclist is in some motorcycle club and the first thing he did was call his lawyer or some motorcycle club guy!!!!!!! NOT 911!!!! his passenger was on the ground bleeding and he was yelling at me and calling a lawyer! Both people on the motorcycle were flown to the phoenix trauma center even though both seemed to be ok..

So anyway, looks like I'll be getting the paint matched on my front end : ... Wonder if they will cover the navan bumper, CF hood???

Anyhow this is a sad day for Zenki's around the world :angry: !

Man, that sucks. Especially cause the guy was being such a jackass about it when it was obviously totally his fault. If you hadn't swerved you probably would have T-boned the cycle and killed them. That ticket you got is total b/s, I don't know the specifics but if it was dry out and you were going the speed limit than it's total crap. It sounds like the cop didn't care or know enough to understand what happened and tried to make it look like both drivers were equally at fault. That shouldn't be too hard to get thrown out. What did the cyclist and his passenger have to say about who was at fault?

Reasonable and Prudent.... IE I should have slammed on the brakes or whatever... which I did! the biker turned so fast I didn't have much time to react..

Man, that sucks but at least no one is dead. What insurance do you have? When I had a little problem with a CF hood flying up on the freeway and doing a bunch of damage to my car, State Farm replaced everything, even the CF hood, and with one of much higher quality

Usually it's the bikes that are getting cut off. What an arsehat. Show up to court and get that ticket dismissed. That might carry some weight with the accident. This could get ugly if the costs exceed your limits. Airlifts aren't cheap and neither are hospitals.

Fight it.. you have a witness and you obviously tried to stop, I don't know of anyone who sees a Motorcycle that cuts infront of them and instantly thinks "insurance claim, i won't hit the brakes"

the cop seems to lack common sense.. why would you not have tried to stop? You were going the speed limit, you weren't expecting some little punk ***** to cut across on his bike.. goto court and ask the cop when he got you with the radar, what speed you were going and why he thinks you didn't attempt to stop.

I'm sensing some over reaction and some drama from this lawyer of his (if he got ahold of him).. if there was only minor bleeding I think an ambulance would have been enough, not a friggin airlift.

It's because of retards like this I have my insurance so high.. I'm covered $100,000/$300,000/$100,000 w/ an additional $2k coverage for aftermarket parts on my car..

Should have pulled the ebrake. If the cops would have seen tire marks on the road they would have had no reason to even suspect you of it.

Guy on the bike=complete idiot. I hope he has some damn good insurance.

the officer probably cited them both so that they could get it sorted out in court, since the only witnesses (from the description) were involved/passangers in the accadent. my advice would be to get (or at least consult) with an attourny, wrecks are no fun glad you are okay

another thing, if it is ruled that both of you were at fault, his insurance should pay for his stuff, and yours should pay for yours

If AZ is a no-fault state then yea he will have to pay for his own medical sh!tz... I hope its not no-fault collision tho... If it's not no-fault collision then his insurance better cover the damage on your car...

In MI, since its a no fault state when someone ran a red light and crashed into my car, my insurance had to pay for the collision damage. WTF...

progressive is the worst insurance company for when you get in a wreck. long story trust me. They're kicked out of the shop I work at... largest body shop in texas. if your ins company has to cover your losses I'm sorry. Some shops and ins compaines will not put on aftermarket parts like c/f hoods or different bumpers. but some will give you the money for oem replacements and you may buy your parts that you wish. Everything depends on your adjustor and the shop you take it to.

make sure to get a copy of the police report and what not, maybe the jackass won't try to make any lawsuits or anything like that too waste your money...
