The best thing to do is to write a letter, first of stating the problem and then your action.
Do not write it in the first person, or avoid it if all possible.
NO "I ordered the blah..."
Yes "ON October 4th 2005 an order was placed for 1 blank exhaust from overboost.com to be shipped to blank. At that time the amount was paid in...Since that time communication between overboost and myself has indicated.....

That is how standard complaint forms for civil action are written.
Don't sound to whinny, be polite and professional, do not interject your opinions or emotions. Just state the facts and the solution.
and most importantly, don't act like a lawyer.
I've seen people write companies with similar situations, and forge letter heads and what not pretending to be from a law firm to "scare" the company.
1st off, if you act like a lawyer, be damn sure that they are going to not only respond to you, but they will check up on your creds.
We were reading about a situation where this guy faked being a lawyer to get money back from Dell for a computer. He made his own letterhead and all that junk, well, dell's legal department got a hold of it, and now the dude is not only being counter sued by dell for millions, there is a pending civil and criminal investigation pending from charges presented my the American BAR association.
So writing a letter is a good thing, remember that the squeaky wheel gets the grease, just don't pretend to be something your not.
