4 points in 1 accident? how?

hi, my gf got an accident this jan in the state of CA that she is in fault of. No death, no DUI.

She just got an insurance renewal letter and they said 4 points are now added from the jan accident. Yes, 4 points instead of 2, is that normal?

Depends on the circumstances of the accident. Did she blow a stop sign or a red light? Was she speeding? Following too close? Reckless driving?

I think she wasn't paying attention and rear ended someone, by no means it is stop sign or speeding or reckless

the damage was about 1500 to her car and 1000 to another party. they probably claimed bodily cuz it is "Free money"

Even if they claimed BI, its 2 points max here in CA. The only thing that could add more points from the CA system is if she was cited and convicted for any moving violations by an officer (from my experience, this is very rare, but not unusual). I would call your insurance company or agent for more details. It could be something as simple as a clerical error that is causing this. You might want to check with DMV as well. AFAIK, DMV doesn't track points for accidents as they aren't provided any notification by insurance companies of who was determined to be at fault. Its a possibility the courts might report this kind of info, but it would have to go through trial before that can happen. Regardless, insurance companies usually calculate the points from an accident based on the fault determined in the claim and the amount and types of payouts. To qualify as a chargeable accident, the driver must be determined to be 51% or more at fault and there must be at least $750 in property damage or injury/death. In the case of only property damage, its one point. For injuries/fatalities, its 2 points. The information about accidents are usually already available to the carrier if the policyholder was insured with them at the time of the accident or through a letter of experience when its new business.

Again, contact your carrier to find out how they calculated 4 points. If its an obvious error on their part, they can quickly correct it. If its something else, how they came up with the points should provide you a place to start figuring this out.

dear c-kwik, thanks for your detailed response. Your insight toward this matter is will appreciated.

She actually made the effort to call her insurer Infinity Insurance however the result has been frustratingly inconclusive. I believe she was told that yes all 4 points are from the accident in Jan but is unable to get more information past that. I too believe this is some kinda of error on insurer end because it is suppose to be a minor accident with no complications. As a result, her renewal policy now has an additional premium fee of $2800 for a 08 Corolla.

wish Colorado had an forced point law in case of accident.I got t-boned in an old Subaru by an old man who ran a redlight doing 60 in a 45 and all he got was a failure to yield to a redlight,and afaik in Colorado that's no points and just a fine.

I assume she received a citation. Might want to check it. Your GF might have left something out. I believe in one of the accidents where my wife's car got hit in PA, the other driver ended up with 4 points. The perp in my wifes accident, ran a red light while speeding, while yapping on his cell phone, without his seatbelt on and in a construction zone (where fines get doubled), He ended up T boning a Lexus who spun into my wifes car (who was 1st car sitting at a red light). there were many witnesses.
