New & Used Vehicle Service Agreement (VSA) Coverage Terms and Conditions

SECTION THREE - COMPONENT COVERAGE

Diamond:Your VSA provides coverage for the repair or replacement of all factory installed parts of the vehicle due to failure, less the deductible You selected, except for the items listed in Section Eight: “What is not covered by this VSA”

NAMED COMPONENT COVERAGE (Items 1-12)(ONLY THOSE PARTS LISTED BELOW ARE COVERED. ANY PARTS NOT LISTED ARE NOT COVERED.)

1. ENGINE: All internally lubricated mechanical parts within the engine block including: crankshaft, connecting rods, pistons, wrist pins, piston rings, rod and main bearings, balance shafts, oil pump gears and housing, timing chain and tensioner, timing gears, camshaft and bearings, valve lifters, rocker arms/cam followers, pushrods, exhaust and intake valves, valve springs, distributor housing, distributor shaft and gear. (External): Intake and exhaust manifolds, metal valve covers, flex plate, water pump, harmonic balancer, crankshaft pulley, timing gear housing and cover, metal oil pan. The engine block and cylinder heads are also covered if damaged only by Failure of a covered internally lubricated engine component listed above. Seals and gaskets for this group of components are only covered in conjunction with a covered repair. 2. TRANSMISSION: All internally lubricated mechanical parts within the transmission case including: main shaft, gear sets, bands, bearings, sealing rings, steel and friction clutch plates within the clutch pack, front pump gears and housing, valve body, torque converter, metal transmission pan and side cover, overdrive unit. (Standard): All internally lubricated mechanical parts within the transmission case including: main shaft, gear sets, bearings, synchronizers, shift forks, spacers, synchronizing drum and gears, overdrive unit. (Automatic and Standard): The transmission case is also covered if damaged only by Failure of a covered internally lubricated transmission component listed above. Seals and gaskets for this group of components are only covered inconjunction with a covered repair. 3. FRONT WHEEL DRIVE: All internally lubricated mechanical parts within the final drive case including: carrier case, bearings, gear sets, chain and sprockets, external universal joints, axle shafts, drive shafts, constant velocity joints, front hub bearings. The final drive housing is also covered if damaged only by Failure of a covered internally lubricated final drive unit component listed above. Seals and gaskets for this group of components are only covered in conjunction with a covered repair. 4. REAR WHEEL DRIVE: All internally lubricated mechanical parts within the drive axle housing (differential assembly) including: carrier case, bearings, gear sets, limited slip clutch pack, universal joints, axle shafts, drive shafts, axle hub bearings. The drive axle housing is also covered if damaged by Failure of a covered internally lubricated differential assembly component listed above. Seals and gaskets for this group of components are only covered in conjunction with a covered repair.5. FUEL DELIVERY SYSTEM: Electric or mechanical fuel supply pump, fuel injection pump (gasoline only); metal fuel delivery lines, fuel injectors (gasoline only), fuel tank, metal fuel rails, fuel pressure regulator (gasoline only). Seals and gaskets for this group of components are only covered in conjunction with a covered repair.6. BRAKES: Master cylinder, equalizer/combination valve, wheel cylinders, disc brake calipers, backing plates, steel lines and fittings, vacuum assist booster. Seals and gaskets for this group of components are only covered in conjunction with a covered repair.7. FRONT SUSPENSION: Upper and lower ball joints, upper and lower control arms, control arm shafts, , stabilizer shafts, , steering knuckles (spindle), , wheel bearings, coil springs, torsion bars, leaf springs.8. REAR SUSPENSION: Upper and lower control arms, sway bars, wheel bearings, spindles, coil springs, leaf springs.9. STEERING: All internally lubricated parts within, and housings for, the following: power steering pump, steering gear assembly, power cylinder assembly, rack and pinion assembly, external steering intermediate and main shafts idler arm, tie rods, center link. Seals and gaskets for this group of components are only covered in conjunction with a covered repair.10. COOLING SYSTEM: Engine cooling fan motors, cooling fan assembly, fan clutch, radiator, internal/external transmission cooler unit, engine thermostat. Seals and gaskets for this group of components are only covered in conjunction with a covered repair.11. AIR CONDITIONING (Front): Compressor, clutch and pulley assembly, orifice tube, manually operated A/C control head, evaporator, condenser, accumulator, receiver/dryer, expansion valve, high and low pressure cutoff switches, idler pulley and bearing, blower motor. Refrigerant and oil are also covered if required in conjunction with replacement of the above covered components. Seals and gaskets for this group of components are only covered in conjunction with a covered repair.12. ELECTRICAL: Alternator, voltage regulator, starter motor and drive, starter solenoid, front and rear windshield wiper motors , front wiper switch, headlight switch, turn signal switch, ignition lock cylinder and switch, neutral safety switch, brake light switch, horns, fuel gauge sending unit, manually operated mechanical switches, power door lock actuators, power window motors and regulators, , front and rear window washer pumps, analog instrument cluster, cruise control module/servo/transducer, electronic ignition computer/control module, ignition crank sensor, electronic fuel mixture control unit.

SECTION FOUR – OPTIONAL COVERAGE for EMERALD and RUBY (Included in DIAMOND)

ELECTRONIC HIGH-TECHA/C: temperature control programmer & computer; rear A/C evaporator and blower motor. Brakes: (ABS) electronic wheel sensors, electro-hydraulic proportioning control valves, pump & computer module/control processor. Electrical: electronic digital instrument cluster, keyless entry system (excludes remotes), electronic coil packs and module/igniter for the DIS system; vehicle manufacturer installed anti-theft device; power sliding door motor and sensor, convertible top motor, seat heaters, motors and memory module, power mirrors, original factory installed AM/FM/CASS/CD player (replacement may be aftermarket only with Administrator’s authorization), amplifier, equalizer and speaker systems.. Suspension: electronic height control (EHC) compressor, sensor/actuator. Seals and gaskets for this group of components are only covered in conjunction with a covered repair.

SEALS AND GASKETSStand alone seal and gasket coverage for Your selected covered component groups.

SECTION FIVE – OPTIONAL EMISSION COVERAGE (AVAILABLE ON ALL PLANS)

EMISSION SYSTEM ONLY (Limited to vehicles with less than 50,000 miles on the odometer at time of VSA purchase)Mass air flow sensor, MAP sensor, O2 sensor, EGR valve, air pump, canister purge solenoid, knock sensor.

SECTION SEVEN - MAINTENANCE REQUIREMENTS

In order to keep Your VSA in force during its term, You must maintain Your Vehicle in accordance with the severe requirements of the Manufacturer’s Maintenance Guide, as shown in Your Owner’s Manual. If the Manufacturer requires synthetic oil to be used, once Your Vehicle is outside of the Manufacturer’s warranty based on time or miles, You must change your oil and filter every 5,000 miles or six months, whichever is less. If the Manufacturer’s transmission is non-serviceable, We will allow up to a maximum of $4,000 for the cost of repair/replacement of your transmission or transmission related failures. KEEP ALL MAINTENANCE RECEIPTS AND RECORDS from your vehicle purchase date, as the Administrator may require verifiable receipts to ensure You have properly maintained Your Vehicle. If You perform Your own maintenance, keep all receipts for the purchase of oils, filters, and other parts purchases, along with a log indicating the mileage and date at the time You performed the maintenance. YOUR FAILURE TO PROVIDE PROOF OF MAINTENANCE ON REQUEST CAN RESULT IN DENIAL OF THE COVERAGE AFFORDED BY YOUR VSA.

SECTION EIGHT - WHAT IS NOT COVERED BY THIS VSA YOUR VSA DOES NOT PROVIDE COVERAGE FOR, OR APPLY TO, THE FOLLOWING CONDITIONS:

A. Physical damage; alignment of bumper/body/trim parts; glass; lenses, bulbs, fuses, sealed beams, fiber optics or any other illumination devise; wiper blades; bright metal; jacks; fasteners (i.e.: nuts, bolts, clips, screws, pins, studs, brackets, clamps, rivets, etc.); safety restraint devices (Diamond plan includes airbag electrical component coverage); paint; rust; upholstery; sun visors/sunshades or roller blinds components/motors, Quadra Steer/ All Wheel steering components; plastic or plastic-like items such as, but not limited to: plastic valve covers or intake manifolds, cup holders, tanks; hinges, moldings, bezels or consoles; keys or key chips; heated steering wheel; electronic spoiler; any remote devices; carpet; rubber or rubber-like items; convertible top/window; vinyl top; weather-strips; squeaks and rattles or any other noise; interior/exterior ornamentation; video entertainment systems; appliances; web access/phone systems; Mercedes Benz Command Center/Module; voice-activated devices; body sheet metal, bumpers, body panels, structural framework, structural welds; water leaks; wind leaks/noise; sealants/caulking tubes, materials/shop supplies, hazardous waste/disposal charges and other maintenance parts and services. Also excluded are: wheels, wheel balancing, rims, valve stems, wheel covers; tires (other than expenses as outlined under Section Nine “TIRE ROAD HAZARD COVERAGE” or Section Ten “TITANIUM PACKAGE BENEFITS”). All after market parts or accessories, whether installed by the manufacturer or not, including but not limited to: CB Radios, cellular phones, audio systems, high performance parts and/or accessories, performance chips, injectors, performance upgrades.B. Service adjustments, reprogramming and cleaning, suspension alignments, refrigerant/recharge, coolant flush, lubricants, battery, battery cable, belts, hoses, spark plugs, spark plug wires, glow plugs, filters, distributor cap and rotor, strut inserts, CV Joints due to dry rot or tears, shock absorbers, brake linings/shoes, brake pads, rotors, drums, brake hardware kits, clutch plate/lining, linkage/hydraulic cylinders, pressure plate, flywheel, throw-out bearing, pilot bushing, exhaust system and emission systems, repairs to retrofit or replace components due to compliance with any federal/state law or legislations.C. If the Air Conditioning system is unable to be repaired due to the shortage, unavailability, or restriction of Cloro-Fluoro Carbons (CFCs) by Federal Mandate (i.e.: freon, R-12), then We do not have any further obligation for repair of the Air Conditioning system under this VSA. We have no obligation to install a retrofit kit on Your vehicle that would allow use of any alternative to CFCs. D. Repairs or replacements that did not have Prior Authorization from the Administrator, except Emergency Repairs (see Section Ten under “EMERGENCY REPAIRS”).E. Pre-existing conditions. F. Any failure caused by misuse; abuse; negligence; lack of normal maintenance required by the manufacturer’s maintenance schedule for Your vehicle (see Section Seven under “MAINTENANCE REQUIREMENTS”); improper servicing by You after Your effective date of Your VSA; sludge build-up, varnish, carbon, corrosion, rust, lack of proper and necessary amounts of fuel, coolant or fluids/lubricants.G. Repairs to seized or damaged engines due to the continued operation of your vehicle without sufficient lubricants or coolant. Subsequent damage to covered components/parts due to Your Failure to protect Your Vehicle once a Failure occurs or warning lights/gauges/sensors indicate(s) a problem exists. You are responsible for making certain that the oil and temperature warning lights/gauges/sensors are functioning properly. You must immediately cease operation of Your Vehicle to prevent any further damage when either of these lights/gauges/sensors indicates inadequate protection or performance.H. The cost of diagnosis, teardown or disassembly, reassembly, fluids, oils, additives, coolant, filters and lubricants if it is determined that the Failure was not caused by a covered component/part Failure.I. Any Failure caused or attributable to any alterations that have been made to Your vehicle.. This will include, but not be limited to the failure of any custom or add on part; any frame or suspension modifications; lift kits; oversized/undersized tires or wheels; modifications to the engine, emissions or exhaust system. Any failure attributable to pulling a trailer if determined that the vehicle was not properly equipped as recommended by the Manufacturer. Any Failure caused or attributable to You using or if You have used Your vehicle in a manner not recommended by the Manufacturer.J. Any repair for the purpose of correcting engine compression or oil consumption when a Failure has not occurred. Burned valves, valve grinding, and burned pistons are not covered. K. Any Vehicle used for any form of competitive driving or racing, any form of commercial use, rental, police, emergency, for-hire/public livery, snow removal. Also, coverage is not afforded to motor homes, any truck or van rated over one (1) ton Gross Vehicle Weight (GVW) or any van conversion kit packages.L. Any Vehicle that has been reconstructed from salvage, any new or pre-owned import Vehicle which has not been originally manufactured to U.S. specifications, and/or has been imported through means other than a factory authorized distributor/importer, commonly known as “gray-market automobiles.” Any Vehicle that is designed or converted to run on alternative fuel or electric power (excludes Honda and Toyota Hybrids).M. If it is determined that Your Vehicles odometer has been inoperable for more than fifteen (15) days or 500 miles, Your VSA will be voided. N. Loss caused by natural occurrence or disaster, larceny, explosion, fire, smoke, water, freezing, vehicle collision/accident or upset, falling objects, breakage of glass, vandalism, riot or civil commotion, acts of war or bodily injury and property damage arising from or allegedly arising from a covered Failure.O. Any Failure occurring outside the continental United States, Alaska, Hawaii or Canada or while Your Vehicle is being used without Your express permission and consent.P. Repair/replacement of a covered component/part as the result of a Failure by a non-covered component/part. Q. Repair/replacement of a non-covered component/part when damaged as the result of a Failure by a covered component/part.R. Any covered part which has not Failed, but which a Repair Facility recommends to be replaced.S. Misdiagnoses or incomplete diagnoses.T. Any reimbursement for loss of time, inconvenience, loss of Vehicle use, loss of profits, storage charges, telephone calls, special freight charges incurred in obtaining parts, lodging and meals (other than expenses as outlined under Section Nine “TRIP INTERRUPTION PROTECTION,”) or any other consequential damage.U. Any repair/replacement that is the direct result of a mechanical or structural defect for which the Manufacturer has announced its responsibility by a recall, technical bulletin, or any other announcement for the purpose of correcting such defect, or for the repair to any component/part covered by a Federal Emission Warranty. Repair or replacement of any components/parts while covered by any Warranty (Manufacturer’s or Repairer’s) or Insurance policy. V. Any components, parts, or costs involved with updating or retrofitting Your Vehicle, or due to product changes, lack of product availability or government regulations.W. Driving on tires which are deflated or improperly inflated, tires transferred from another vehicle, damage to tires that do not affect their performance or safety, tires mounted on vehicles other than on-road use private passenger cars and light duty trucks, tires mounted on vehicles exceeding one (1) ton gross vehicle weight (GVW) and tires not retained by You for inspection by the Administrator.

SECTION NINE - CONVENIENCE BENEFITS (INCLUDED IN ALL PLANS)

SUBSTITUTE CAR RENTAL:When a covered Failure occurs and Your vehicle must remain at an authorized Repair Facility, We will pay or reimburse You to rent a substitute vehicle (excluding fuel charges, optional insurance, and mileage). Such expense shall be limited to thirty dollars ($30) per day, for a maximum of five (5) days per occurrence ($150 total). Your car rental benefit is based upon the number of labor hours required to perform covered repairs as listed in the nationally recognized labor time guide. Each eight (8) hours of listed labor, or a portion thereof entitles You to one (1) day of rental coverage. Example: 0.1 to 8 hours equal one (1) day, 8.1 hours to 16 hours equal two (2) days, etc. The substitute vehicle must be rented from a licensed auto rental agency. This coverage does not apply to time waiting for parts or other delays beyond the control of the Repair Facility or Administrator. In the event of a major component (engine, transmission or drive axle) replacement, a maximum of up to three (3) days parts delay coverage may be afforded provided additional authorization is obtained from Us. Car rental benefits are not provided for or in conjunction with: other benefits, delays due to Repair Facility scheduling, weekends, holidays, or for repairs not covered by Your VSA (Except where prohibited by law).

TRIP INTERRUPTION PROTECTION:In the event a Failure covered by this VSA occurs more than one hundred (100) miles from Your home, We will reimburse You up to fifty dollars ($50) per day for up to three (3) consecutive days for receipted motel/restaurant expenses. The date of Failure will be considered the first day of the three (3) day maximum period (Except where prohibited by law).
