3rd brake light

Is it illegal to not have the 3rd brake light?

Nope.

It's illegal to build a car that doesn't have one, but it ain't illegal to remove it.

My spoiler (and CHMSL) will be gone as soon as I can afford to have the rear decklid repainted.

CHMSL = center high-mount stop light.

its not manditory for the 3rd light but howcoem you gotta have it if you build a car?

Manufacturers are required to include it - NHTSA (federal law) requirement.

i think it depends on the state you live in. Some states require it at all times, some don't. I'm fairly positive Virginia has a law stating that the 3rd light has to be present. But it's been a federal highway and safety board regulation for going on 2 decades to have it present. What the motorist does with it after purchase can't be controlled by the manufacturer.

can you modify it legally? i.e. relocate make it clear (if anyone would want to) or even darken it?

if its on an aftermarket spoiler does that still count?
