They may be relying on the profile of the tire being narrower nearer the tread (away from the hub that is). Plus, the motion of the wheel is not straight up and down - the top of the tire "tips in" when moving up, so it may clear the fender edge.
An alternative is to roll the fender to give the tire some room.

Ummm ... please be careful and check the fitment (not saying that you should not do it - just check it carefully at a friendly tire dealership who will mount and check wheels)!
With a 10" width, that 45mm offset may contact suspension components since the wheel will sit further "in" than a 40mm offset wheel. But, since I have not tried this myself, all I can say is "check it out carefully", since the stock 2006+ M wheels (which are narrower than 10" wide!) have 47 and 50mm offsets, by the way.
