Hi Guys,

This is the first time I am posting on the forum, if you believe I should post this in another section please let me know.

I live in NYC and my car was recently towed by NYPD Traffic. I had parallel parked in between two vehicles and wondered how NYPD Traffic was able to even tow my car in the first place. Then I saw this video on youtube:

When I retrieved my vehicle, I checked the entire vehicle for scratches, dents, etc and found up and down scratches on the rear bumper. I was furious! I check my vehicle everyday for scratches and dents since I purchased it in May 2011 and never had a scratch on it before this!!

As I was leaving the tow pound, I spoke to a supervisor and a few other NYPD Traffic officers and they told me that I probably made the scratch. I told them absolutely not and that I check my vehicle every time I exit the vehicle for scratches. She then told me that someone else was leaving the spot and the person behind me bumped into my car. No vehicle would leave a vertical scratch like this while trying to leave a spot--instead it would be a horizontal, swiped motion scratch if anything. Then the officers told me that this was a front wheel drive and that it was hoisted by the front wheels, so damage would not occur on the back bumper. Complete b/s! If you see the youtube video, you will see that the car was moved backwards so that the wheel lift would have better access to get under the wheels. Once the wheel lift is under the car, then the front of the vehicle moved upward and the back of the vehicle moved downward, which created the vertical scratch on my car. We explained this to the officer and she just said that's not what happened. Another officer said that they don't reverse the vehicles, yet at the pound we took video of them reversing the vehicles into the spots. Basically nothing they said added up. I will fight this and appreciate any help or feedback in the matter.

In addition to the scratch, I'm pretty sure my handbrake was up when I parked my vehicle, though I'm not 100% sure. Since the back wheels were on the floor while being towed, would this damage the brakes or anything? Should I get the car checked out? Thoughts? Please comment.

Thank you.

Trust me brother, they don't really give a hoot. Your best bet is to show recent photographic proof that the damage didn't exist prior to the tow. Find out also how they towed it. If it was improperly towed, the CVT may be damaged.

It's going to prove to be difficult to have them admit to any damages done to the car.

My brother had his Maxima towed in NYC. When we went to pick up the car we were dumbfounded to see how they move cars out of the way in the lot. They simply used a forklift to lift the front wheels of the car blocking my brothers. Then when we got in the car we found that his car manual was missing and so was his jack and cargo net from the trunk.

In the end, they never admitted responsibility for any of it and we can only imagine how 'carefully' the car was treated while being towed.

I hate window pane videos. People need to learn to turn the thing 90 degrees.

Without a dated photo if the car immediately before the tow, you can't prove anything. I am sure they get complaints constantly about damage, some probably caused by them, and a lot probably that was existing. It's your word against the system, and you were parked illegally and got towed. It will cost you far more in legal fees and stress to keep fighting them rather than just to fix the scrapes.
