2009 "Service Engine Soon" Cold Start ECU problem?

So last week my "Service Engine Soon" light came on my 09 EX. The dealer read the error code and stated it was a known "Cold start issue" on the current ECU firmware for most Infiniti models.

They reset the light and was told the only information they have is Infiniti is currently developing a new ECU firmware and when it is released they will contact me to upgrade. They claim there is no harm to continue driving as normal.

Has anyone else had the same problem? Does anyone have any information on the problem?

I have a 2010 Model, but in my 2007 Toyota Camry with only 5000 mile on it, I started it up one morning recently and my check engine light came on. I was told on that car it was "normal too", also the light went away after a day of driving it and when the weather warmed up. Haven't had the EX35 long enough so I'm not sure if they have fixed this issue, probably not if they still don't have an updated firmware for the 2009 Model.
