2009 Rogue 48k miles 1QT extra CVT fluid?

Hi. I am wondering if someone has some insight into this. A number of months ago, I got a recall notice for an ECM reprogramming (emissions related components have a 8 year warranty and CVT has 10 year) so I took it in. Since then, the performance of the car had dropped significantly. After repeated inspections by the Nissan shop that did the work and being told that Nissan released a software update to prevent future issues with tailpipe emissions caused by high temperatures, I just accepted it and lived with the higher rpms and lower performance (significantly lower - like 20, 25%).

On a recent road trip, I had to pass a big trailer truck and had to go from 60-80 on a dry, level road but the car just would not go. I floored it, it hit 5-6k rpm but would not go any higher and it just took so much longer to pass the trailer. I opened a case with Nissan and they asked me to take it back to the dealer and asked for a full diagnostics. They did that, told me again that all was as it should be and the same to Nissan. They did a "Air Idle Volume Relearn" but that did not do anything.

Furthermore, they removed 1Qt. CVT fluid because they claimed "whoever did the last CVT fluid change put in too much fluid".

This car has never had the CVT touched; It has 48k miles on it. During a door panel recall in March, they inspected the CVT fluid and said "no rush but I may want to look at doing a CVT fluid change within the next year" ... fair enough. Nothing else was wrong with the car.

But now, all of a sudden where did that extra 1Qt. CVT fluid come from?!?

Any advice? Is just saying they did something with the CVT Nissan code for being able to charge Nissan for their time (they did not charge me for this inspection that Nissan requested that apparently took them a few hours to do).

Did removal of that quart of fluid make any difference in the way the vehicle runs?

I see no difference ... performance is still the exact same as after the ECM re-programming
