2007 M35x Trunk Won't Close

I have an issue with the trunk closing. The latch will not lock so the trunk remains open at all times. It seems to be the popper or whatever the spring loaded mechanism is called is stuck on released. I can push it back down but it just pops back. The latch on the trunk seems to be working fine because I can simulate locking with a screw driver and it works both with remote, as well as emergency release and interior release switch. Is there a fix or will I need a new piece for the trunk to latch on. Just to clarify the piece I am talking about is in the middle of the trunk right next to the molding. Will post pics when I figure out how from my iPhone
