2005 Maxima transmission, very rough downshift

Have 2005 Nissan Maxima bought new with 64K, just stumbled onto website about federal lawsuit concerning faulty transmissions in 2004 thru 2006 Maximas, Altimas. Web site indicates class action suit in Federal Court in California, attorneys site is Chimicles.com. Claim is Nissan knew of faulty valve body even before I purchased my vehicle new in '05. Already have thousands of people who have joined suit. Nissan refuses to even admit problem. Claim is rough, even jerking downshift from 3rd to 2nd and other problems. Apparently even with rebuilt Trans's from Nissan Service Department same problem occurs, sometimes within one year of rebuild. Anybody got any info on why Nissan is not Fessing up and fixing this problem?

At question are app. 60,000 transmissions, so I assume that the reason(s) Nissan is not "fessing up" is because 1) it would be costly, 2) they are maintaining, in court, that there is no evidence that they knowingly sold faulty transmissions, and 3) the original plaintif dropped the complaint back in 2012 (reasons not given).

These cars are now as much as 11 years old, so perhaps they feel it will go away pretty soon as the cars in the class go out of service one by one. They are playing the waiting game. I.e. the legal costs are less than the potential settlement costs ($100,000,000 or more by my rough estimation).
