Definitely not a fuse. The entire system is powered with two fuses for both cooling and heating fuse 42 is a 15a for the drivers side seat, 41 is a 15a for the passenger side seat. Both provide power to the seats through a relay. So basically car battery to relay to climate control units. There is one fuse which supplies power to the actual relay and that is a inside fuse #12 a 10a fuse. Since you mentioned both seats have power this is not the source of your issue.
The heating/cooling unit in climate controlled seats is actually a TED (Thermo Electric Device) device. Two ends where one side provides heat when powered while the other side provides cool when powered. These devices are powered by the climate control seat control unit. Does this occur when you leave it on cool for a time? There is a sensor which according to the FSM SE for 2008 M35 prevents the system from working for extended periods of time if it detects 20C/68F differences in temperature between the seat cushion and the TED. To reset this turn the car off and back on again.
