So here's my dilemma and maybe someone else has been here and could be willing to give some guidance, thank you in advance.
My transmission finally gave up. But the good news is I found a 98 infinity qx4 motor and transmission with 89000 on both for 500 bucks! Maybe you already know the issue..... It the same 3.3liter motor, good solid transmission that is the same..but the transfer case on a qx4. Is electronic. Mine is manual. Im guessing its a push button 4wd and mine has a shifter.
Any. Suggestions?

The real issue is making sure the TCM connections on your Pathy and the QX are identical, and that not having actual control of the Transfer Motor won't make the QX TCM go "limp". You'll definitely need to fool a few things like the Transfer Fluid Temp sensor. If that checks out and the manual case mates up mechanically, just keep it. If it doesn't, but you're sure the transmission is identical (and you need to make sure of that), I don't see why you can't hook up a switch, relay and warning light and use the electric box manually. The mechanism uses a simple DC motor, see page TF-16 here:
https://www.nicoclub.com/service-manual ... 8%2Ftf.pdf

The motor is driven by the TCM on the QX, but it doesn't need to be. Setting up a 20A fuse to feed a Bosch Box 30A relay with a 4WD warning lamp should work fine.

Would matter too much if the transmission were different if the engine is swapped too? Cause the 98 qx4 is a donor for my. 98 pathy. Same engine 3.3 but the transmission stamps are differnt

Different transmission means a different TCM. Like I said earlier, making sure the electrical connections match up is what's critical. The QX TCM will have extra wires because of the electric Transfer Case, so you need to make sure it's the same connector on both vehicles, that the basic harness pinouts match up, and then dummy any signals like Tranfer fluid temp that would make the QX TCM throw codes. I'm sure it's doable, you just may have a crapload of homework.

Nope. I don't know of anybody who's done this swap, so where the "cross compatibility" line ends is anybody's guess, both mechanically and electrically.

So we were able to swap everything and the paths transfer case stayed on the replacement. We were able to swap out the adapter housing and all the connectors lined up and connected. Went to fire it up and there's no spark we had intermittent spark nut now . on the distributer connector terminal or pin 5 has no power. Any ideas?

Pin 5 gets power from the ECCS Relay, so either the ECM is down, the relay coil has no power, or there's no Start Signal to the ECM. Since the ECM gets main power direct from the Ignition Switch, option 1 is improbable. Check fuse #62 in the Fusible Link Box for relay power and fuse #26 in the cabin fusebox for the Start Signal (should go hot with the key turned to the Start position).

See page EL-227. It's the relay closest to the fender in the Fuse and Fusible Link Box (Relay Box 2):
